Youth jailed for part in attack on three boys

One of three youths, described as “the second most brutal assailant” in the attack on three boys, aged 14, in Radley Park, Woolston, earlier this month was sent to youth prison for 12 months by Judge Frampton in the District Court yesterday.

The Judge told Faamalaga Faimalo, aged 17, a carpenter (Mr B. J. Pelham), that there were no mitigating circumstances to the attack, by himself and his two associates.

It had been a premeditated and deliberate assault on three young boys, each of whom suffered injuries of varying degrees.

A sentence of corrective training, limited as it was to only three months, would not reflect the gravity of the offending, or serve as a deterrent to others, said the Judge.

Mr Pelham said his client was ashamed, and deeply regretted his involvement in the offending.

Faimalo categorically denied any indecencies with the complainants, he said. Faimalo had admitted

charges of injuring each of the three boys with intent and robbing one of them of a $l5O wrist watch. He was also convicted on unrelated charges of trespassing at a city cinema on January 16 and resisting a constable in the execution . of his duty. Earlier in the day, Steven James Parsons, aged 18, and Riki Peter Jarden, aged 17, both unemployed (Mr K. J. Grave), were convicted on offences relating to the Radley Park assault. Parsons, described by Detective-Sergeant B. M. Roswell as “the instigator and principal assailant” was remanded in custody to February 4 for a probation report and sentence.

Parsons admitted three charges of assaulting the boys with intent to injure them, three charges of indecent assault, and three of robbery. Riki Peter Jarden, aged 17, unemployed, who admitted charges of Injuring two of the youths with intent, was remanded on bail of $l5OO to February 10 for a probation report and sentence. about 3.15 a.m. on January 19 the three complainants, who sharing a caravan at the home of one of them, decided, because of the heat, to go for a walk to cool down.

They dressed and walked to the comer of Sheldon and Radley Streets where they were confronted by the three defendants who forced them into the playground in Radley Park.

For the next 30 minutes the boys were repeatedly attacked, punched, and kicked. They were robbed, made to strip and two of them were ordered to masturbate, said Sergeant Roswell. The boys’ clothing was thrown over fences bordering the park. The complainants were told they would be killed if they told anybody about what had happened, he said. A watch, a wallet, and a small sum of money were taken from the boys.

Sergeant Roswell said all three defendants had been drinking before the attack.

Parsons admitted to the police that he had been the instigator of what followed.

He admitted taking money from the boys into his possession, ordering the three to strip, and ordering two of them to masturbate. He was also responsible for throwing the boys’ clothes away. The names of the complainants were suppressed. CARPETS THEFT A man who took $32,257 worth of carpets and vinyl, after burgling the Lichfield Street premises of Specialty Carpets, Ltd, told police he committed the offence because he had numerous bills to pay, said Sergeant Roswell. John McKinnon Donnelly, aged 33, a selfemployed painter and decorator (Mr G. D. Horne), admitted the offences, which took place overnight on January 16.

He was convicted and

remanded on bail of $l5OO to February 10 for a probation report and sentence.

Sergeant Roswell said that on January 17, a search warrant was. executed at the defendant’s address, where 40 Persian carpets and four rolls of vinyl were recovered in the garage. All the stolen property had been recovered, he said. In seeking bail, Mr Horne said sureties were available. ESCAPE CHARGES No plea was entered by Whiu Arthur Carroll who is charged with escaping from Paparua Prison on January 26. Carroll, aged 26, was remanded in custody to February 3. He was recaptured later the same afternoon after being found missing from a work party at 2.30 p.m. Mathew Hill Tamakehu, aged 24, unemployed, was also remanded to the same date, without pleading, on a charge of assisting Carroll in escaping.
