Trademark battle to Privy Council

PA Wellington Montana Wines, Ltd, has received leave of appeal to go to the Privy Council in an effort to stop another New Zealand wine maker from using its trademark in advertisements. Villa Maria wines features a bottle of Montana wine in its 'advertisements and compares it with a similar wine it produces. Montana gained an injunction from the High Court last year to stop further publication of the advertisement but earlier this year the Court of Appeal overturned it. “We are now pressing to get a Privy Council hearing

in London ,as soon as pos£ sible,” said Montana’s managing director, Mr Bryan Mogridge. “We are taking steps right now to obtain an early date of hearing.” The company was determined to go ahead with this move as it believed«the advertisements were against wine interests in New Zealand. Wine companies should promote individuality rather than claim to be like each other, he said. “We regard the advertisements as a deliberate attempt to pull a smaller company along by attaching itself to a strong market leader,” Mr Mogridge said.
