W.E. Lowe’s appeal is successful
The appeal ' by the Hinds owner-trainer, W. E. Lowe, against the relegation of his horse, Stortford Lodge, from second to fifth in the Lord Module Supporters’ Handicap at the Banks Peninsula meeting on October 6 was upheld at a hearing in Christchurch yesterday. The appeal judges, Messrs B. D. Kinley, L. A. Butterfield, and D. C. Watts, ordered that the appeal deposit be refunded. Stortford Lodge was reinstated to second placing, with Borana third, Supreme Ruler fourth and Mighty Me fifth. In their finding the appeal
judges said that Stortford Lodge had taken the line of Mighty Me in the run home, but the interference was minimal and they could not determine whether the placings had been affected. The appeal judges also said that they were concerned that the race-day judicial panel had not given Mr Lowe any chance of giving evidence or questioning witnesses even though he was readily available to do so. Mr R. A. Young appeared for Mr Lowe and Mr B. McClelland for the .Trotting Conference.
