Appeal on dismissal of caretaker rejected
A claim by a worker that he had been unjustifiably dismissed by the Leithfield Reserves Board has been rejected by the Arbitration Court.
The claim was brought by the Labourers' Union on behalf of David Lawrence Smith who claimed that he had been unjustifiably dismissed as caretaker last October. The case was heard in Christchurch in February and the decision was re-
leased this week. Chief Judge J. R. P. Hom held that Mr Smith’s job as hitherto performed by him, had disappeared. "By not applying for, nor
accepting, the enhanced position available to him, which included further duties and a place of residence upon which it was proper for the board to insist, his dismissal as a consequence must be held justified." the Chief Judge wrote.
