False rape complaint
PA Blenheim A woman was given a suspended sentence yesterday for making a false complaint of rape to the police. Cheryl Margaret Cain, aged 22, of Kaikoura, appeared in the District Court at Blenheim having been convicted of the charge in the District Court at Kaikoura.
Counsel, Mr Richard Wilkes, said that Cain made the complaint after she had spent the evening at a hotel. Her de facto husband went home but she stayed on and was plied with drinks. She later had sexual intercourse with another person and made the complaint because she was concerned about her position at home. Mr Wilkes said that Cain genuinely regretted making the complaint. Judge Headifen said that Cain was not likely to reappear and could not afford to pay a monetary penalty. He ordered her to come up for sentence if called within 12 months.
