Board to sue for Maximart ‘debt?’
The Christchurch Drainage Board may be forced into the debt-collecting business. Lawyers acting for the Christchurch City Council say that the board should sue L. D. Nathan, Ltd, which refused to pay the council $4257 still owing for restoring part of New Brighton Road after a stormwater sewer was installed for the company's Maximart store two years ago.
The board had changed contract conditions effectively to prevent the council from claiming the “ultimate restoration surcharge,” the lawyers’ letter said. If the board did not collect the money, the council might
have to take legal action against the board. Members of the board have decided to ask its own lawyers for more advice and discuss the problem again next month. The chairman of the development and construction committee, Mr T. B. Whelan, said the “debt” had cropped up before and probably would again. Questions have also been raised about the validity of the surcharge. The sewer installation was a board contract and Woolworths paid those, costs, but the surcharge was meant to be paid direct to the council.
