Claim sequel to dismissal
The Arbitration Court reserved its decision in Christchurch yesterday on a personal grievance claim brought by the Labourers Union on behalf of David Lawrence Smith against the Leithfield Reserves Board. The applicant union alleged that Mr Smith was unjustifiably dismissed from his position as caretaker for the board in October, 1982. It sought reinstatement, an order for payment of lost wages, and compensation. The advocate for the union
was Mr R. A. Lowe. Mr N. McPhail, advocate for the respondent board, said that Mr Smith had not been dismissed. He had agreed to a fixed term of employment and the termination’amounted to a mutual or consensual one. If the Court held that there was a dismissal, then the respondent claimed that it was justified. The Court comprised Chief Judge J. R. P. Horn and Messrs J. A. Boomer and P. L. Oldham.
