p A Auckland Steven John Forsyth, aged 17, of Manurewa, has been committed for trial on a charge of the murder of his elder brother, Tony, aged 21. He was remanded in custody by Judge Hall after a twq-day depositions hearing in the District Court at Otahuhu. The Judge also committed Dennis Phillip Oxley, aged 18, of Manurewa, to the High Court for trial on a charge of the murder of Tony Forsyth, and on an alternative charge of being an accessory after the fact of murder by helping to dispose of the body.

Both youths pleaded not guilty to the charges after the. Judge ruled that prima facie cases had been established. The Crown alleges that Steven Forsyth and Oxley killed Tony Forsyth and then put his body, weighted with .concrete blocks, in an estuary near Papakura. The mother of the Forsyth youths/ Mrs Esme Forsyth, told the Court that Steven was scared of his elder brother’s sometimes violent temper. She said that he was known in the house as “The ■ Boss,” and had often hit his younger brother.
