Skybus man’s claim dropped
PA Auckland A claim brought by a former Skybus promoter, Mr Matt Thompson, against a firm of solicitors was struck out by a High Court Judge in Auckland yesterday. The motion to strike out the claim for $85,000 was brought by the two defendants named in Mr Thompson’s original action; an Auckland firm of barristers and solicitors, Martelli McKegg Wells and Cormack, and Martelli McKada Nominees. Ltd. Counsel for the applicants (Mr F. W. M. McElrea) said that the plaintiff, Mr Thomp-
son, had failed to comply with an order for discovery made against him within the time limit.In addition, Mr Thompson had been adjudged bankrupt and the Official Assignee did , not wish to continue the ; proceeding begun by him, or > accept any liability for costs. Mr McElrea said the claim had previously been dismissed by the court by way of non-suit. Mr Justice Speight struck out the claim and made no order for costs after hearing from Mr McElrea that he did not wish to pursue that matter.
