Delivery ban illegal

The ban on delivery of fuel to Ministry of Works sites and Musgrove Bros is apparently illegal. Delivery of fuel is classified as an essential industry under the Industrial Relations Act, and unions must give 14 days notice of any refusal to deliver, which is regarded as strike action. The executive officer of the Oil Industry Union of Employers (Mr S. Marshall) confirmed yesterday that the Canterbury Drivers’ Union had not given the required 14 days notice. He said that the Department of Labour was aware of this. It has the power to bring prosecutions. “Regrettably, the law is abused so much it appears to have been overlooked,” said Mr Marshall. The oil industry employers were fully aware of the legal implications of the fuel bans, and had been in consultation with the affected parties. The oil industry employers would not enlarge such a dispute without full consultation, so Mr Marshall said any question of suspending the drivers had been ruled out at present. “We hope the dispute will be settled soon,” he said.
