PA Wellington A' $30,000 damages award for libel has been set aside by consent in the High Court,. s ? In February, a jury awarded damages to JJames Samuel. Montecino, entertainer, against Wellington Newspaper, Ltd, The action arose from an article in,. “Truth”- on May 15, 1979, headed “Snoring his way to that record,” in which it was alleged Mr Montecino slept for 20 hours of the 100 hours and 10 minutes during which he
established a /world marathon piano playing record in 1924;
In court yesterday, -Mr Montecino’s counsel, Mr -J; D. Dalgety, said that the parties had agreed to ask that the judgment be, set aside and that a lesser ’sum than the jury’s award, had been paid to Mr Montecino. On behalf' of “Truth,” Miss S. M. "oran confirmed this.
The Chief Justice (Sir Ronald Davison) made an order setting aside the judgment.- ?; ,
