Appeal by schoolboy dismissed

PA Wellington An appeal by a schoolboy, aged 15, against his conviction for the murder of two young children has been dismissed by the Court of Appeal. The boy had been convicted in the High Court at Christchurch of the murder of his step-brother and stepsister, aged four and three. An order was made prohibiting publication of the names of the boy or the two young victims.

The Crown alleged that while babysitting for the children during his parents’ absence on March 26 last year he inflicted multiple stab wounds on them.

In an oral judgment on behalf of the Court, Mr Justice Woodhouse said there were two possibilities, either that the boy killed the children or that his explanation be accepted that five men came to the house and killed them. The Court was satisfied that any reasonable jury would reject such an explanation, his Honour said. The other members of the Court were Mr Justice Richardson and Mr Justice Ongley.
