Butchery restricted
Tenderkist Meats (N.Z.), Ltd, may build a large butcher shop at the comer of Yaldhurst Road and ' Brake Street if it restricts itself to retail sales on the premises, the Planning Tribunal (No. 2 Division) has said in a decision.
The company appealed to the tribunal after the Waimairi County Council disallowed the application in the commercial C zone, both as a conditional use and a ! specified departure, the status of the application being in doubt.
The tribunal ruled the application a conditional use. The zone was designed to prevent such an enterprise, and the scheme would have to be changed under specified departure status. As a conditional use, the application was “out of zone” in two respects, the tribunal said. To conform,
all smallgoods made on the premises would have to be sold at retail prices on the premises, and goods stored could not be processed. However, the company planned to redistribute some of its goods to other retail outlets for sale, and would be processing on the site. If conditional use was defined as “any process or manufacture of goods for sale by retail on the premises,” the application would conform if business was limited to a straightforward retail enterprise, including bulk [sales to hotels, the tribunal said.
“The evidence indicates that any detraction from residential amenities would not be greater than that experienced from any large butcher shop.” Of the fat-rendering process, the tribunal said it was satisfied that the process planned would remove any
potential element of noixiousness. [ If the company did not (modify its retail enterprise I the appeal would be dismissed, the tribunal said.
