Sales tax powers
PA Wellington Regulations giving the [ Minister of Customs power to exclude homemade goods from sales tax were gazetted yesterday. The regulations follow the discovery by Customs officials that two clauses in the Sales Tax Act, taken together, mean that anyone who builds such things as boats and caravans at home for his own use becomes a I manufacturer and should be [charged sales tax if the item I its worth mor ethan $lOOO.
This interpretation has now been overtaken by the regulations, which give the Minister blanket power to exclude anything made at home from the sales-tax provision. The regulations also give the Minister power to impose conditions on the exemptions. The Prime Minister (Mr Muldoon) said on Monday that boats made at home would be excluded from the sales-tax unless they were sold within two years, but this is not spelled out in the new regulations.
