Civil costs to rise

Costs which can be awarded to successful litigants in some civil cases in the Magistrate’s Court have been increased. The increase in the maximum costs which can be awarded by a magistrate, the first increase in 10 years, does not necessarily affect a lawyer’s actual charges to his client. Under the new scale, an unsuccessful party in a civil action can be ordered to pay more towards the legal costs of the successful litigant. In a default action on a claim for a debt of between $lOO and $5OO, for instance, the sued party is now liable to pay up to $lO costs for the plaintiff’s preparation of the statement of claim.
