Injunction continued

A horse owner and a jockey, both disqualified by the Australian Jockey Club on Thursday, won two court fights over the issue.

The owner, Mr F. Calvin, and the jockey, Peter Cuddihy, in the Equity Court, late in the afternoon, won a continuation of an injunction which restrains the A.J.C. from enforcing the disqualifications. The A.J.C. immediately appealed to the Court of Appeal comprising three Supreme Court Judges. The Court unanimously dismissed the appeal and ordered the A.J.C, to pay costs of the appeal.

Mr Calvin and Cuddihy were both disqualified for 12 months bv the A.J.C. stewards on March 26. They were charged with breaching the rules of racing in that the horse Count Mayo was allegedly not allowed to run on its merits in a race at Randwick on March 13.
