Dr Brych’s appeal move almost set

Zealand Press Association) AUCKLAND, February 20. Dr Milan Brych’s appeal against a Medical Council move to strike him off the New Zealand Medical Register might be heard next month.

The lawyers acting for the controversial cancer therapist, Mr R. K. Davison, Q.C., and Mr D. G. R. Short, hope that a Supreme Court fixture can hie arranged within the next few weeks. But a complicating factor could he that the judge who granted Dr Brych an interim injunction last November. Mr Justice Beattie, is at present presiding over the trial of William Ball Sutth. the former Secretary of Industries and Commerce, on charges of breaching the Official Secrets Act. It is usual court practice for the judge who grants an interim appeal tp take the subsequent hearing. The Medical Council struck Dr Brych off rhe register on November 8 on the alleged grounds that he had falsely represented he held

.a doctor's degree from Masaryk University, Czechoslovakia. Dr Brych immediately lodged an appeal with the Supreme Court. Mr Beattie granted an interim stay of the. Medical Council action on November 12, after Dr Brych’s lawyers ' had produced a sworn affidavit from an unnamed Czechoslovakian witness stating that he knew Dr Brych to be a properly qualified medical practitioner. Dr Brych has since continued treating cancer; patients at the Adventist Hospital and at a further’ Auckland private hospital.' but he has also made several trips overseas partly to gather evidence for his appeal. His lawyers say he now has all the affidavits he needs, and they are almost ready to apply for a hearing.
