Calley: Army to appeal
(N.Z.P.A.-Reuter — Copyright) WASHINGTON, Oct. 1. The United States Government has announced its intention to appeal against a Federal Court decision to quash the conviction of the former army lieutenant, William Calley, on a charge arising from his role in the My Lai massacre. Judge Robert Elliott ruled last week that Calley was denied even a fair chance of a fair trial by being "subjected to a massive outpouring of prejudicial publicity, and by being balked in his attempts to call highranking Army officers and Defence Department officials as witnesses.” The Solicitor-General (Mr; Robert Bork) said yesterday that Judge Elliott’s decision would be taken to the Court of Appeals. In the meantime, army lawyers would request the Court of Appeals in New Orleans, Louisiana, to require that Calley be kept confined to the military prison at Fort Leavenworth, Kansas.
