Fifth judge withdraws
(N.I. Pretn Asin.—Copyright) SAN RAFAEL (California). . j May 11. Judge A. Lindsay yesterday withdrew from the Angela Davis conspiracy case on the motion of Ruchell Magee. Davis’s co-defendant. Judge Lindsay was the fifth judge to withdraw from the case, which has been bogged down in pre-trial motions for months. Judge Lindsay said he would ask the presiding judge of the Marin County Superior Court to appoint a successor, but the matter was expected eventually to wind up with the State Judicial Council, which appointed Judge Lindsay. Judge Lindsay ruled that a challenge by Magee to his qualifications made last week was peremptory—a right Magee can exercise only once, but against which a judge has no recourse. Magee, aged 31, and Davis, aged 27, are charged with murder, kidnapping and conspiracy in connection with the Marin County Courthouse shooting on August 7. 1970, in which a judge and three others were killed. Judge Lindsay last week staved off a challenge to his qualifications by Davis, whose lawyers said he was a white racialist. But against Magee’s peremptory challenge he had no choice but to withdraw.
