A judge has refused to dismiss the claim of a Negro Air Force veteran who alleges he became an albino during: treatment at the Veterans’ Administration Hospital in Cleveland almost six years ago. The Negro, James Finley, aged 33, filed a suit against the Government in June. 1966. alleging that his skin changed colour when he was receiving medical care at the hospital. An Assistant United States A’tornev. Mr Donald Jaffe, argued vesterday before Judge Frank J. Battisti, of the District Court, that the twovear Statute of Limitations allowing Finley to file charges had expired before he laid his suit.

Overruling the argument. Judge Battisti said that it was not until August. 1964, that Finleys skin peeled then grew back without pigmentation. He said that the Statute of Limitations did not begin to run until medical treatment administered by a mal-prac-tis’hg phvsician ceased. The Judge said that Finlev’s suit, which alleged that treatment with a drug caused his skin to turn white, would probably be heard in May or June.
