MAGISTRATE’S COURT Man With “Shocking List” Fined $l00 On Burglary Charge

I Rangi Samuel Repia, aged 49, a driver, who counsel said had spent 26 years behind bars, was fined $lOO and ordered to make restitution ■ of 524 when he appeared before Mr W. F. Brown, S.M., | in the Magistrate’s Court yesI terday for sentence on a charge of burglary of the home of Janet Stephanie Miles on January 29. Mr G. R. Lascelles, for the accused, said that Repia had been declared an habitual criminal and was on parole until 1974. He had married and had been out of prison for nine months, which was a record for him. It was a very silly offence. Repia had been driving along Fitzgerald Avenue when he saw a door of a house open. He went in and while making a (search put his orderbook down and forgot it. Repia ■was a good workman. The Magistrate said that at ■ 9.30 a.m. on January’ 29 Re;pia had climbed through an unlocked window of the 'house and had taken $l6 and .'a pen set valued at $B. His only explanation was that he had had a row with his wife. Repia had a shocking list of convictions and had spent ! most of bis life in gaol. Mr McVeigh said the defendant had a sorry list of previous convictions, but it was evident from the probation officers report that this, in part J at least, was the result of his shocking upbringing. The Magistrate said that on February 2 Keane had been given a suspended sentence when he appeared for sentence ;on a charge of unlawfully interfering with a car because his co-offender had been dealt with' in a similar manner. The defendant filled in a cheque for $lO for the Papanui Dairy, and cheques for $2O each at the Ferry Road Self Help Store and the Craig and Harvey Dairy in Waltham Road. Sergeant Townshend said the defendant told a detective he had committed the offence against his better judgment and regretted it. He wanted to be dealt with and have the matter put behind him. The defendant said he was desperate for money to buv food and clothing. At 1.45 p.m. on January 1 a traffic officer saw Timmings driving on the middle line of Yaldhurst Road at 20 to 25 miles an hour, said Sergeant Townshend. He turned into Riccarton Road and travelled hard (against the kerb but had to swerve to avoid a parked car. A blood test showed that he had 180 milligrams of alcohol per 100 millilitres of blood. Frederick William Townsend, aged 28, an engineering labourer (Mr R. F. Powell), was fined $7O and disqualified from driving for one year as from February 17 on a charge of driving with an excessive amount of alcohol in his blood He pleaded guilty. A traffic officer saw Townsend weaving across Annex Road and nearly hit a fence, said Sergeant Townshend. A blood test showed that Townsend had 165 milligrams of alcohol per 100 millilitres of blood BURGLARY Brian Puarakau Harrison, aged 33. a driver (Mr E. J. Higgins), was convicted and remanded in custody to February 17 on a charge of burglary at Kokatahi on 'January 22. He pleaded guilty. The complainant was asleep in his house when he heard a noise in the adjoining shop at 1.45 a.m., said Sergeant Townshend. The complainant (investigated and found Harrison behind the counter by the safe. ! Harrison ran out past the complainant and the police were called. Money had been taken frum ■ a cash box. Harrison was 'later found asleep in a Hokitika hotel. He handed over $46 in cash and a cheque to .the police. PROBATION ' Joseph Edwards, aged 20, a tussock grubber, was admitted Ito probation for two years, ordered io take out a prohibition order, his driver’s licence was cancelled for a year and he was ordered to make restitution of $35 when he appeared for sentence on a charge of un lawfully taking a car valued at $l5OO. the property of the Maori and Island Affairs Department on December 31. and unlawfully interfering with vehicles valued at $2OOO and $3OOO. the property of the Department of Scientific and Industrial Research. The Magistrate said that the probation officer had found it hard to obtain information about Edwards's past. He had far too much to drink, went to the Christchurch City Council car park at the corner of Manchester and Gloucester Street, interfered with two vehicles and had driven a third out of the building into the street. Edwards was a first offender. DANGEROUS LITTER Malcolm Hugh Elston, aged 17. was fined $l4 on a charge of depositing dangerous litter, a bottle, on Marshland Road, on December 24 He pleaded guilty. Sergeant Townshend said that at 2 30 p m. on December 24 Elston was a passenger in a car travelling north on Marshland Road when he threw a soft ■ drink bottle out of the window on to the side of the road. It, was not known if the bottle I broke. Another motorist re , ported the matter to the police _ When seen by the police Elston admitted the offence and said that he just wanted to get rid of the bottle and did not know he was committing an offence OBSTRUCTED FOOTPATH Epeniha Ben Rarere, aged 24, a builder s labourer, was fined $2O on a charge of obstructing the footpath in Cathedral Square on February 6. Lascelles), was fined $5O On November 27 a traffic officer and special constable employed by the Lyttelton Harbour Board saw Mitchell talking to a Chinese seaman from a shin berthed at Cashin Quay, said Mr C. A. McVeigh, who appeared for the Customs Department. Mitchel] went on board the ship with the seaman and when he came off he appeared to have something in his windjacket. He was taken to the customs shed and he admitted buying three radios for $BO. Mitchell bought the radios because he could not resist the temptation, said Mr Lascelles. Appearing for the S.P.C.A., Mr D. A. Oldham said two of the society’s inspectors had collected several puppies after the fire brigade had attended to a fire in Hamilton's properly. The society claimed $195 for keeping the dogs .since October 11. but Hamilton .had paid $29. Mr Lascelles said Hamilton normally looked after the dogs very well. At one stage he had 25 dogs and was spending $2O to $24 a fortnight on them. Five of the dogs should have been put down but he did not have the heart to destroy them. CARELESS USE Martin Robinson, aged 21. a storeman (Mr B. A. Barrer), was convicted and fined $l5 and ordered to pay witnesses’ expenses of 818.70 on a charge of careless use of a motor car. He pleaded not guilty. Evidence was given that a collision bad occurred on the Lewis Pass Highway at Rough Creek bridge on October 27. Prosecuting, Sergeant J. D. Burrell called two witnesses who said that the car In which they had been travelling was halfway Off the one-way bridge when struck by Robinson’s car. They said that Robinson’s car had scraped alongside their cat and had hit the wheel of the boat trailer that their car wap towing. ’ Robinson said that he bad stopped his car about one quarter of the way along the bridge and that the complainant had attempted io drive his ear through the gap. but had failed because it was a one-way bridge. Damage to both cars was minor, he said. The Magistrate said that it was not his function to appor tion blame, but t.o decide whether Robinson was guilty bevond all reasonable doubt of careless use. He said that he was quite satisfied that this! was the case, and that Robin-: son had approached the bridge; too fast.
