WHANGAREI, April 29.

The appeal by Mr N. D. Cullen, former general manager of the Northland Harbour Board, against his dismissal was adjourned sine die this afternoon.

This came after a conference this morning between counsel and an appeal board set up under Section 45 of the Harbours Act 1950. When the board resumed this afternoon, Mr .1. D. Gerard. counsel for the harbour board, said that board members had learnt of Mr Cullen’s acceptance, in evidence and through his counsel, that it was not possible for him to be reinstated as general ; manager. "And as doubts exist as to the jurisdiction of the appeal board to deal with the situation in any other wav. i in order to avoid the possibility of injustice arising, it has been agreed that Mr Cullen will withdraw his appeal." Mr Gerard said “A majority of board members, who have met informally. have agreed that they will recommend to the Northland Harbour Board at its next regular meeting that the board pay Mr Cullen $5OOO as compensation for loss of office." At the suggestion of Mr H V. Gilliand. S M.. chairman of the appeal board, the hearing was adjourned sine die. Mr Gilliand said the adjournment would not involve a further sitting.
