MAGISTRATE’S COURT Youth Remanded For Sentence On Three Burglary Charges

Garry Bernard Barrett, aged 20, an unemployed workman, was convicted and remanded in custody to August 21 for sentence by Mr W. F. Brown, S.M., in the Magistrate’s Court yesterday on three charges of burglary at Rangiora on July 8, and two charges of unlawfully getting into a motor-car on the same date. He pleaded guilty. Sergeant V. F. Townshend said the defendant frankly admitted the offences when interviewed on August 13. The three other offenders involved had already been dealt with by the Court. Of the goods and money totalling $250 taken in the burglaries, only property to the value of $20.36 had been recovered, said Sergeant Townshend. DISCHARGED “This is a case of desperate poverty of a woman with an unblemished record, a useless husband, and a history of illness, who is trying to bring up a family,” the Magistrate said when discharging a woman without conviction en a charge of theft of groceries valued at $3.69 from a supermarket on July 25. The defendant, whose name was suppressed (Mr M. J. Cashmere), pleaded guilty to the charge. Sergeant Townshend said the defendant had $l4 in her possession when arrested. She told the police she did not pay for the goods so that she could pay off outstanding debts. In describing the defendant’s circumstances, Mr Cashmere said she had been subject all her married life to a grinding and most abject poverty. FINED *lOO Robert Hohepa Rukl, aged 55. a builder's labourer, was fined a total of (100 and placed on probation for one year when he appeared for sentence on charges of assaulting Constable T. Moore on August 6. and assaulting Margaret Edith Shaw on the same date. He was ordered to take out a prohibition order for one year. FINED 850 On a charge of assaulting Brian Robert King on August 13, Joseph William McFetrish. aged 18, a welder, was convicted and fined $5O. He pleaded guilty. The Magistrate said the defendant already had convictions for assault, and this was a bad one of its kind. Sergeant Townshend said the defendant struck the complainant in the stomach as he came out of a lavatory at the Rendezvous Dance Hall, and then on the side of the head. A few minutes later in the dance hall he hit him about the head and body. After his arrest, the defendant said he should have hit the complainant harder. FINED $2O Michael John Hart, aged 25, a cleaner, was fined $2O and disqualified from driving for three months when he appeared for sentence on a charge of unlawfully interfering with a motor car at Spencerville on August 5. PROBATION , Robert Makene, aged 25, a

pattern setter (Mr D. H. Stringer), was placed on probation for one year when he appeared for sentence on a

charge of stealing a change rurse and contents valued at 2.50 on July 8. He had previously been convicted. Mr Stringer said it was a stupid and mean type of theft, but poverty was the motivating force behind it. The defendant wanted to provide food for his wife and family. Since his appearance in Court the defendant had been dismissed from his employment. FOUND IN BAR Ivan Hugh Batchelor, aged 17, a student ' teacher, was convicted and fined $8 on a charge of being a minor found in the United Service Hotel tavern bar on July Is. He pleaded guilty by letter. Mr R. J. Allan, for the accused. said that because of Hamilton's background it was almost inevitable that she would offend. She had tried to run her own life but had not made much of a job of it. The shoplifting episode appeared to be out of character and she had stolen the toaster to help a girl friend with her fare to Wellington. ’’lt is true you have had a far from good start In life but you are quite an intelligent girl and all you need to do is to take a bit of pride in yourself,” the Magistrate said. “You have previously shown a weakness towards theft.” FINED $lOO Wayne Robert Andrews was fined $lOO and his driver's licence was cancelled for a year when he appeared for sentence on a charge of driving while disqualified. He was fined $5 on a charge of giving false information and ordered to pay Court costs of $lO.

Mr K. N. Hampton, for the accused, said Andrews had a number of convictions for traffic offences but all except one of them were for offences of a minor nature. After giving the false information he had later voluntarily admitted the offence to the Transport Department.
