Magistrate Criticises Dismissal Threat

fNZ. Press Association) NEW PLYMOUTH, April 12. “I am not going to have Government departments dictating what the Court should do,” said Mr A. W. Yortt, S.M., in the New Plymouth Magistrate’s Court. The Magistrate told Mr G. P. Monaghan, counsel for a youth appearing for sentence on a charge of indecent exposure, that too many Government departments held out the threat of dismissal for an employee whose name was published in relation to an offence. Counsel had asked for suppression of the youth’s name in view of his continued employment with a Government department “Other employers are prepared to take their employees back. Government departments above all should cooperate in helping people instead of sacking them,” said the Magistrate. He granted suppression of the youth’s name but “not because the department had threatened to sack him.” The youth had earlier pleaded guilty to the charge. He

was placed on probation for 18 months with the condition that he undergo such psychiatric or medical treatment as the probation officer directed or the Court recommended.
