December 29. Evidence was given that Scott was driving south when he crossed 3(t en to the wrong side of the road when making 4 left turn. His car collided with one being driven north by Frederick Thomas Humphrey.

After the impact Scott's cat eroded the road on to Us correct side and plunged down a bank to a rocky beach. His father, william Scott, aged se. one of the passengers ip the car, died in the Kaikoura Hos pital the following morning. William Scott Had been receiving treatment for a heart complaint and had been taking a drug to stop hla blood from clotting. When he was admitted to hospital this treatment was stopped because of His injuries The doctor, who performed the fiost-mortem examination, gave he cause of death as heart failure. This was caused by the increased coagualablllty of Mt Scott’s blood caused by his injuries and cessation of the anti-coagulant drug. He had suffered head Injuries and abrasions to the body. The accused’s car was badly damaged and Mr Humphrey's only slightly In a statement made to Constable G. A. He was travelling about 30 miles an hour and was in the middle of making a left turn when he saw the other car coming. He did not know where his car was in relation to the middle of the road. The impact was only a slight one In the agony of the moment the accused had over corrected and that had sent the car over the bank.
