MAGISTRATE’S COURT Charges Of Burglary, Receiving And Forgery Admitted

“These offences are bad. In some cases they strike at the very roots of the social security system,” Mr K. H. J. Headifen, S.M., said in the Magistrate’s Court yesterday when convicting an unemployed workman on 20 charges involving burglary, theft, receiving, forgery and causing persons to act on forged documents. Clive Lawrence Ilich, aged 24 (Mr D. M. Palmer) pleaded guilty to four charges of burglary involving property worth $3207, a charge of theft of $3lO in money, a charge of receiving social security family benefit ordei books and other order books valued at $4897 knowing them to have been dishonestly obtained, seven charges of forging benefit orders for $165, and seven charges of causing persons to act upon them as if they were genuine. The offences were committee* at Auckland, Christchurch, Tauranga and Katikati between November 20, 1966, and August 20, 1967. The defendant was remanded in custody to September 6 for sentence. Sergeant V. F. Townshend said the defendant had 36 previous convictions. Restitution of $3987 was sought FINED S4O On a charge of careless driving in Cashmere road on August 5, Donald McLean, aged 30, a welder (Mr D. H. Godfrey) was convicted and fined £4O. He pleaded not guilty. A charge of driving while under the influence of drink or drugs on the same date was dismissed. LIQUOR OFFENCES On a charge of supplying liquor to a minor on June 30, Anne Block, manager of the New Zealander Hotel, was convicted and fined *2O. She pleaded guilty. Stewart John Sanders, aged 17, was convicted and fined 120 on a charge of purchasing liquor in the New Zealander Hotel while a minor on June 30. He pleaded guilty.

DISMISSED A charge against Duncan Brian Livingstone, aged 26. a taxi driver (Mr R. L. Kerr) of assaulting Yvonne Dorrell Pankhurst on August 9 was dismissed. He pleaded not guilty. Pankhurst, aged 20, unemployed, was remanded on ball to September 6 on a charge of making a false statement to the police on August 9. She was represented by Mr Kerr.

REMANDED A man, whose name was suppressed, was remanded on bail to September 19 on a charge of threatening to kill a man on August 18. He pleaded not guilty, and was represented by Mr L. M. O’Reilly. TRAFFIC OFFENCES Careless use of motor vehicle: Austen Lee Watson, *l2: Peter Geoffrey Heazlewood, *2O; William John Gopperth, *8; Kevin Graham Wilson, *2O, disqualified tor three months. BORSTAL TRAINING “You have been utterly defiant. your behaviour has been completely irresponsible: detention centre taught you nothing,” the Magistrate told Douglas Walter Uren, aged 17, an unemployed brush hand (Mr K. J. Fuimaono), when he sentenced Uren to a period of Borstal training. Uren appeared for sentence on a charge of driving while disqualified on August 22. It was his second conviction for driving while disqualfled since he was disqualified from driving tn February this year. REMANDED John William Barnes, also known as John Bolt, aged 33. an unemployed butcher (Mr J. M. Wilson), elected trial by jury on four charges relating to possessing and uttering £lO Australian bank notes on August 3 In Christchurch. He was charged that, knowing that the bank notes were forged, he caused Jennifer Elizabeth Nlcholl, a bank officer, and Gordon Raymond Mowat to act on the bank notes.

The two other chargee were (or possessing forged bank notes.

Mr Wilson applied for bail for Barnes, but DetectiveSergeant D. J. T. Joy strongly opposed bail. A further application was heard in chambers and ball refused. Barnes was remanded until today. DROVE UNDER INFLUENCE After he had bought a new car, Robert Stevens, aged 48, a farmhand, took the vendor and his wife to the Templeton Hotel and “shouted” for them. As he drove away from the hotel he was stopped by a traffic officer on the Main South road and arrested for driving under the influence of drink or drugs on August 22, the court was told. Stevens pleaded guilty and was fined *BO and disqualified from driving for three years. Detective-Sergeant Joy said a blood test at the police station showed that Stevens had 210 milligrams of alcohol per 100 millilitres of blood.

DISMISSED Maureen Hazel Turrell, aged 23, married, a toll operator (Mr A. M. Maclean) pleaded not guilty to a charge of careless use of a car on Blenheim road on July 2. After the evidence of the E rosecution and the defence had een heard, 'the Magistrate dismissed the charge. Gormack, Justices of the Peace) COMMITTED FOR TRIAL Jim Zoltan Somlay, aged 34, a textile worker (Mr P. D. Woolley), was committed for trial to the Supreme Court in Christchurch on a charge of threatening to kill a woman on July 19 In evidence, the woman, whose name was suppressed, said she had broken off an association with Somlay in January. On July 19, Somlay telephoned her and in the course of their conversation, threatened to kill her. Later he telephoned and said he was sorry for the threat.

The same night, the witness said, she was driving along Breezes road with another woman when Somlay passed them in another car and slowed in front of them.

Later at the lights at Fitzgerald avenue and Cashel street, Somlay stopped and opened the door of her car. She told him to go away and as he went he said he would “get” her for that. The woman drove immediately to the police station. Ronald Ethelbert Tibbots, aged 42, a driver, was committed for trial in the Supreme Court, Christchurch, on a charge of attempting unlawful sexual intercourse with a girl on July 30. (Before Mr H. J. REMANDED Brian Francis Johns, a butcher, was remanded on ball until September 1 for a probation officer's report and sentence on a charge of driving while disqualified in Memorial avenue on June 10, and supplying a false name. Traffic Officer T. L. Scammell said Johns had been convicted of driving while disqualified five times between April and June.

Johns gave his name as Arthur Vernon Charles Reardon when spoken to, said Traffic Officer Scammell.

On June 13, Johns admitted being the driver of the car, and said he gave a false name because he was a disqualified driver.

Counsel, Mr S. G. Erber said Johns had been fined ,125 on each, of three of the charges by another Magistrate and disqualified for a total of three years from July 13, 1971.

FINED ,150 “I'm in the wrong and don’t want to wriggle out of It,” said Sydney Barry Huseey, aged 22, a workman, when asked if he had anything to say. Hussey, who was appearing for sentence was fined a total of *l5O on charges of driving while disqualified, driving in a dangerous manner, giving false information and driving an unlicensed motor vehicle.

All offences occurred on July 23.

The Magistrate said Hussey had a very bad record of previous offences including a conviction for false pretences. Huseey was also placed on probation for three years, and disqualified for a further three years.
