Writ Against Radio Hauraki Withdrawn

(N.Z. Press Association) AUCKLAND, April 14. A writ for breach of copyright issued against Radio Hauraki, which included an £lB,OOO claim for damage, and ■ Supreme Court Injunction which sought to restrain Radio Hauraki from putting records on tape for radio programmes, were both withdrawn today. Solicitors for the parties concerned in the two actions, Phonographic Performances (N.Z.), Ltd, of Wellington, the plaintiff, and Pacific Radio Advertising, Ltd., the defendant, told Mr Justice Perry that the points had been settled.

In its writ of summons filed in February, Phonographic Performances claimed that Radio Hauraki had infringed its copyright by broadcasting tape recordings of records for which it was the exclusive licensee in New Zealand. It listed about 65 record labels to which it claimed it had the copyright. The hearing of a motion for an interim injunction against Radio Hauraki came before the Supreme Court last December but was adjourned. Mr L. W. Brown said that amicable agreement had been reached. Formal documents of discontinuance would be filed.

After the hearing, the man-aging-director of Radio Hauraki, Mr D. Gapes, said he did not wish to disclose the terms of settlement.
