MAGISTRATE’S COURT Two Years’ Probation And £513 Restitution

“Obviously drinking and you don’t go together,” Robert William Sutton was told when he appeared for sentence in the Magistrate’s Court yesterday on charges of burglary and unlawfully taking a car on February 3. Mr E. S. J. Crutchley, S.M., said that only Sutton’s medical report saved him from going to borstal. Sutton, aged 19, a workman, was convicted on February 21, when Detective-Sergeant A. B. Dalzell said that during the evening of February 4, a window of C. L. Rhodes Rental Cars was broken, and the office ransacked. Pennies, a sheet of stamps and some pencils were taken by Sutton, who then took a rental car which ran off the road and hit a power pole : near Chertsey. About £5OO damage was ' done to the car, said Detec-tive-Inspector Dalzell. Sutton’s counsel, Mr M. F. Hobbs, said the offences were quite out of character with the defendant’s previous history. He was so Intoxicated he did not know what he was doing. Sutton was placed on probation for two years, and ordered to make restitution of £513 7s as directed by the probation officer. FINED £7O EACH Noel George Vickery, aged 20, a painter, and Ronald Neil Holmes, aged 21, also a painter, were each fined a total of £7O, placed on probation for two years, and ordered to make restitution of £8 10s. They had been convicted of stealing a V 8 motor valued at £5 from the City Wrecking Company on or about February 13; and of the burglary of G. Stewart and Company, 14 Ltemore street, on the same day. “One wonders how you would feel spending 18 months In prison. But I'm most impressed by what was said in the probation report,” the Magistrate told Vickery. He said that Holmes was a tittle immature and had drifted into bad company. FINED £25 Gary Warren Dennys Lewis, aged 19, a storeman, was fined £25, put on probation for one year, and disqualified for one year on a charge of unlawfully taking a motor-car valued at £lOO, on February 20. Lewis, who was appearing for sentence, was not represented by counsel. HARBOURED GIRL When Riichard Alan Barer* was interviewed by the police on November 29, he admitted knowing that a girl, who was staying at 53 St. Albans street, had absconded from a child welfare home, said Sergeant F. G. Mufcare. Rarere, aged 20, a plasterer (Mr J. R. MflMgan), pleaded guilty to harbouring an inmate of a child welfare institution between November 19 and November 29, and was remanded until March 7 for a probation officer’s report and sentence. CHARGE DISMISSED A charge of failing to give way to a car on the intersection of Manchester and Kiimore streets on January 28, against Joseph Konesane Fulmaono, was dtsmassed. Fuimaono (Mr M. G. L. Loughnan) pleaded not guilty. The Magistrate said he dismissed the charge on grounds of conflicting evidence and that he would give the defendant the benefit of the doubt. RECEIVING Warren John Forbes, aged 18, a labourer, was fined £lO and put on probation for a year and a half when he appeared for sentence on a charge of receiving 380 cigarettes, one tin of peaches, and one tin of baked beans, on February 13, knowing them to have been dishonestly obtained. DOG REGISTRATION Trevor Edward Sheehan, of Sydenham, was convicted and fined £1 for failing to register his dog. He did not appear. OTHER CASES Other traffic offenders were penalised as foMows:— Failing to give way: Raymond John Dale, £lO, and disqualified from driving for two months; Robert John EatweCl, £5. HARBOURING CHARGE Susan Hill, aged 18, unemployed, was admitted to one year's probation on a charge of harbouring a girl from the Ferry road receiving home. She pleaded not guilty and was represented by Mr R. G. Blunt.

CHARGE DISMISSED A charge against Larry Victor Hamilton, aged 17, a butcher, of careless driving on Colombo street on December 22 was dismissed. He pleaded not guilty and was represented by Mr G. T. Mahon. The charge arose from a collision between a motor-scooter ridden by Hamilton and a car driven by James Joseph Kerr, which pulled out from the kerb to make a right turn. COSTS ONLY Raymond Haywood, aged 20, an apprentice baker was ordered to pay costs ox £1 10s on a charge of being unable to stop in half the clear distance ahead on November 13. Haywood pleaded not guilty. Evidence was given that a vehicle driven by Haywood ran into a car driven by Ernest Doerflinger, who braked suddenly to avoid a dog in Oxford terrace. (Before Mr H. J. Evans, 1.M.) DANGEROUS SPEED Bruce John Merewether, aged 20, a plastics worker (Mr G. P. Rooney), pleaded not guilty to a charge of driving at a speed which might have been dangerous in Rdver road and North Avon road on November 18. He was convicted and fined £l5, and disqualified from driving for 12 mnoths. On a charge of failing to dieplay an *‘L” label, to which he pleaded guilty, Merewether was fined £2. FAILED TO STOP "The defendant has convinced himself that he stopped, because he always does as a matter of habit, but he has not convinced the Court,” the Magis&ate said, convicting Colin Clive Halford Elderton of failing to stop at the compulsory stop at the intersection of Stanmore road and Avonside drive on December 19. Elderton, a teacher, aged 23, pleaded not guilty and defended himself. He was fined £7. PARKING OFFENCES Warwick Bockett Sykes, a salesman (Mr G. W. Rountree), pleaded not guilty to two charges of parking over the time limit in St. Asaph street on August 5 and September 19. Submissions were made that the spacing of the “P6O” signs in this area was greater than the legal maximum. Sykes was convicted and fined fl on each charge. FOUR CHARGES Chargee against James Mayo, of failing to give way, failing to report an accident, falling to provide information, and having no warrant of fitness, were adjourned to thia afternoon after evidence from two prosecution witnesses had been heard. Mayo a driver salesman (Mr E. O. Sullivan), pleaded guilty to the charge of having no warrant of fitness and not guilty to the others. The charges arose out of a collision at the intersection of Manchester street and Canon street on July 30. TRAFFIC CASES
