MAGISTRATE’S COURT Youth Admits Charges Of Disqualified Driving

Bryce Frank Doidge, aged 19, a workman was ordered to pay costs only on two charges of driving wjiile disqualified when he appeared before Mr H. J. Evans S.M., in the Magistrate's Court yesterday. Doidge pleaded guilty to three charges of driving while disqualified and a further charge of obtaining a licence while disqualified. On the third charge of driving while disqualified he was fined £2O and disqualified for a further year and ordered to pay costs only on the charge of obtaining a driver’s licence while disqualified from driving.

Traffic Sergeant H. J. McMorran said Doidge was stopped on the morning of November 16 by a traffic officer and asked for his licence. He did not have it with him and was told to send it to the traffic department. Later the same day the defendant was taken for a motor-cycle licence test in the city and passed the test, Sergeant McMorran said.

The department later found that Doidge had been disqualified on November 4, and told him, he said. The defendant was interviewed again on November 22 by a traffic officer and admitted riding his motor-cycle on November 20.

Mr Glue said Doidge had not been present in the court when his licence was suspended and was only informed by the registrar that he had been fined.

He applied for a motorcycle test three weeks before he went for the test, Mr Glue said, and at this time neither the traffic department nor the defendant knew of his disqualification. Doidge was aware, however, that he had been disqualified when he rode his motor-cycle on November 20.

DROVE WHILE DISQUALIFIED Trevor Edward Sheehan, aged 22 a railway worker, (Mr M. J. Glue) was convicted and fined £4O and disqualified from driving for a further year on a charge of driving while disqualified on Lincoln road on November 11. He pleaded not guilty. The Magistrate said he did not consider imprisonment this time because of the defendant’s domestic situation but as the defendant had once before been convicted of driving while disqualified he could be sent to prison. John Richard Shamus McMillan, aged 20, a warehouseman, was fined £3O and disqualified from driving for one year on a charge of driving while disqualified on Barrington street on November 23. He pleaded guilty and was represented by Mr L. G. Holden.

FINED £25 Brian Somerfield, aged 45, a manufacturer (Mr G. T. Mahon), was fined £lO on a charge of failing to give way to the right on the corner of Worcester street and Cambridge terrace on August 26. He pleaded guilty. He also pleaded guilty to another charge of failing to give way to the right on the corner of Colombo street and Peterborough street on August 29. He was fined £l5. Mr Mahon said Somerfield had come down from Auckland for a week and was unfamiliar with Christchurch streets. The defendant had braked hard in both instances, but he was at a loss to explain how the collisions occurred.

The Magistrate said that because the accidents had occurred within three days of each other there would normally be a cancellation of the defendant’s licence, but because of his unfamiliarity with the city and his obvious sense of responsibility a fine would be imposed. THEFT A housewife, aged 62, whose name was suppressed, was convicted and fined £l5 and ordered to pay witnesses’ expenses of £6 on a charge of theft of groceries valued at 6s 8d on November 3, in a reserved decision. She was represented by Mr H. W. Thompson. DISMISSED Robert John Gordon, an apprentice electrician (Mr L. M. O’Reilly), pleaded not guilty to a charge of driving on Linwood avenue on July 17 at a speed which might have been dangerous. After hearing the evidence the Magistrate dismissed the charge.

FINED £2 Colleen Maree Buchanan, a manageress, was fined £2 on a charge of failing to display a heavy traffic licence. She pleaded guilty. COSTS ONLY

Gordon Oswald Reinke was ordered to pay costs only on a charge of failing to keep to the left when turning on Cranford street. He pleaded guilty.

DISQUALIFIED ‘'Your actions could have precipitated a serious accident," said the Magistrate when Timothy John Houlden, aged 23, a trainee lineman, was convicted, fined £2O ana disqualified from driving for a period of 12 months on a charge of driving a motor vehicle at a speed which might have been dangerous on Woodham road on July 3. He pleaded not guilty. "You do not appear to be paying much attention to your previous long record,” said the Magistrate. “You are indeed fortunate not to have been sent to prison." DISMISSED Roger Harold Wright, aged 22, a diecaster (Mr G. W. Alexander) pleaded not guilty to a charge of driving a motor vehicle without reasonable consideration on Colombo street on August 25. FINED £l5 Neville Gordon Jiggins, aged IS. a cadet, was convicted, fined £l5 and disqualified from driving for 12 months on a charge of riding a motor-cycle at a speed which might have been dangerous on Ensors road on July 20. He pleaded not guilty. DISMISSED A charge against the New Zealand Express Company, Ltd. <Mr G. F. Rea) of operating a trucfc in an unsafe condition in Manchester street on September 6 was dismissed. The company had pleaded not guilty. FINED £3O “It is incredible to think that such a short time after your last offence you are driving whilst disqualified,” said the Magistrate when William Alexander Zane Galt, aged 22, a hairdresser (Mr M. J. Cashmere) was convicted, fined £3O and disqualified from driving a motor vehicle for a period of two years on a charge that he drove while disqualified on Pages road and Lonsdale street on August 28.

DECISION RESERVED The Magistrate reserved his decision until 2.15 p.m. today when John Roderick McKenzie, aged 19, a student (Mr R. L. Kerr) pleaded not guilty to a charge that he drove a motor vehicle in a manner which might have been dangerous on Park terrace on September 24. McKenzie pleaded guilty to a charge of having no current warrant of fitness displayed on the same day. Traffic Officer W. Noster said he had checked McKenzie over three-tenths of a mile along Park terrace. McKenzie traveile dat 55 miles an hour across the intersection with Kilmore street, Peterborough street and Salisbury street, and at 45 miles an hour across Dorset street. All the intersections were uncontrolled and visibility was good at only two of these, Traffic Officer Noster said. (Before Messrs W. E. Olds and R. W. Gormick, J.Ps.) ABORTION CHARGE

With one prosecution witness still to give evidence, the hearing of depositions against Florence Kathleen Wilson, aged 41, a shopkeeper, was adjourned until December 14. Wilson faces one charge of attempted abortion and three charges of unlawfully using an instrument with intent to procure a miscarriage between August 1 and October 21. Wilson (Mr G. R. DROVE WHILE DISQUALIFIED John William Morgan, aged 36, was fined £4O and had his licence cancelled for a further year on a charge of driving while disqualified on November 15. He was fined £2 on a charge of giving false information. Morgan was appearing for sentence. He was not represented by counsel. “You should realise that you can be sent to prison for disobeying the order of the Court not to drive,” the Magistrate said. “I would not have hesitated to send you to prison but for the fact that you have given an undertaking to sell your car.” FINED £l7

Jules Ogilvie Schaare, a radio and television technician, was fined £lO and had his licence cancelled for three months on a charge of failing to stop after an accident. He pleaded guilty. Schaare was also fined £7 on a charge of driving without reasonable consideration in Bealey avenue. He pleaded not guilty to this charge. Mr J. E. Butler appeared for the defendant. A charge against Warren David Stevenson, aged 21, a meat Inspector, of careless driving at the corner of Linwood avenue and Buckleys road on August 26 was dismissed He pleaded not guilty and was represented by Mr P. G. S. Penlington.
