GIFTS WITH CARS

Police Win Appeal A second-hand car dealer who last year offered a Christmas gift-parcel with each car sold —one of which contained a “jackpot” voucher for a £2OO car—was ruled in the Supreme Court yesterday to have been giving a prize by mode of chance. An appeal by the police, by way of a case stated as to whether a magistrate had been wrong in dismissing such charge against Steve Christenson and Company, Ltd. (Mr E. O. Sullivan), was upheld by Mr Justice Wilson. The magistrate, in holding that no payment, either direct or indirect, had been made by patrons for the prize, and that there had been no allurement in the particular circumstances, had misdirected himself on a point of law, his Honour ruled.

The company was charged after inserting a newspaper advertisement for a “Christmas bonanza” as follows: “You can win this car. Only 18 valuable gifts left, including the 'jackpot’—Vauxhall Velox, valued at £2oo—which must be won before Christmas. One gift with every car sold.” Mr N. W. Williamson conducted the case for the police.
