MAGISTRATE’S COURT One Month’s Gaol For Breach Of Probation

“You know very well you are compelled to adhere to the conditions of probation,” said Mr K. H. J. Headifen, S.M., in the Christchurch Magistrate’s Court yesterday, when sentencing Vernon Henrop Sellars Deal, aged 62, a retired cook, to a month’s imprisonment. Deal pleaded guilty to a charge of breach of probation in Wellington on June 3. He was appearing on arrest after a bench warrant had been issued on Monday when he failed to appear.

A probation officer (Mr G. E. Hodgkinson) said that on August 3, 1950, at a sitting of the Auckland Supreme Court, Deal was declared a habitual criminal after a conviction for a counting-house robbery. On September 1, 1952, he was placed on indefinite licence and released. After serving sentence on another charge Deal was released from Wellington prison on June 2 this year with a written order to report to a probation officer within 24 hours of his release. He failed to do so and had not reported, Mr Hodgkinson said.

The Magistrate said that he had considered Deal’s record and that this was the third occasion that Deal had committed a breach of probation. IDLE AND DISORDERLY Walter Cook, aged 45, an unemployed workman, pleaded guilty to a charge that on August 8 he was deemed to be an idle and disorderly person in that he had insufficient means of support. He was convicted and remanded on bail till August 15. Brian Reid Murphy, aged 53, unemployed, pleaded not guilty to a charge that he was deemed to be an idle and disorderly person in that he had insufficient means of support. He was remanded on bail till August 18. DISQUALIFIED AND FINED

An 18-year-old unemployed youth, Roger John Sanderson, was convicted and fined £lO and disqualified from driving for six months on a charge of failing to keep left on Pages road on June 18. Traffic Officer D. Hill said Sanderson was on a motorcycle going along Pages road toward the city when he pulled out from the group of motor-cyclists he was with and travelled for 200 yards six feet from the right hand kerb. Sanderson pulled back in behind some cars and then overtook them at a speed in excess of 40 miles an hour. The Magistrate said he was not prepared to tolerate that sort of driving. CHARGE DISMISSED Stephen James Savill, aged 22, a student, pleaded not guilty to a charge of failing to supply information between June 9 and June 21. The charge was dismissed.
