MAGISTRATE’S COURT Youth Took Cars And Stole Beer

Peter Waltho, aged 19, unemployed, was remanded on bail to August 8 for sentence when he pleaded guilty to three charges before Mr H. J. Evans, S.M., in the Magistrate's Court yesterday. Waltho was charged with unlawfully taking cars belonging to George Ward Drayton and John Stephen Canham, and stealing a dozen bottles of beer from Kenneth Campbell Allan. Senior-Sergeant G. M. Cleary said that on the evening of July 16 a Transport Department patrol car chased Drayton’s car in Hoon Hay and Lincoln roads. When the car attempted to turn into Annex road it almost ran off the road. The driver, a boy who was dealt with in the Children's Court, and Waltho, a passenger, ran off across the fields. Waltho had previous convictions, Senior-Sergeant Cleary said. FINED £3O FOR THEFT John Seddon Walter Edwin Hall, aged 29, a machine operator, was fined £3O on two charges of stealing pieces of knitted garments valued at £5 and £B. the property of Bradford Knitting Mills. He pleaded guilty. Senior Sergeant Cleary said that at 11.30 p.m. on July 21 the firm's security officer saw Ha'-!. who was working on night shift, place a parcel in his car. Hall had said he took the knitted pieces to make clothes for his four young children because he had money problems. He had no previous convictions. Mr L. M. O'Reilly, for the accused, said the goods taken by Hall were seconds, and he was surprised at the value placed on them in the police statement. Hall had lost his job. Hall had debts of more than £3OOO because of an unsuccessful business he had run in Wellington. He had been working at three jobs in an attempt to pay his creditors because he did not want to go bankrupt. THEFT AT SEA Charlie Henry Alexander Ferris, aged 35, unemployed, was fined £4O and was placed on probation for two years when be appeared for sentence on a charge of stealing a wallet and contents, valued at £29 10s, on an Inter-Island steamer between Welington and Lyttelton on July 21. Ferris was ordered to live and work where directed and not to associate with persons not approved of by the probation officer. "You have a long record of crime and this offence was committed only two weeks after you were released from prison after serving two years for burglary.” the Magistrate said to Ferris. "You have made a career out of law-breaking, and have seldom been out of gaol during the last 15 years. The probation report recommends, with some hesitation, that you be placed on probation. This could be the turning point in your life if you want it to be.” INDECENT DOCUMENT A man, whose name was suppressed, was admitted to probation for 18 months and was ordered to pay £l5 towards the cost of prosecution on a charge of delivering an indecent document to a girl. He was appearing for sentence. Mr M. J. Glue appeared for the accused. UNLAWFUL INTERCOURSE A youth who lived with a 13-year-old girl as man and wife for several weeks in a flat after the girl had run away from home, appeared for sentence on a charge of unlawful sexual intercourse. He is Kenneth Gordon Crossley, aged 17, who was fined £5O and was placed on probation for 18 months. Crossley was ordered to live and work where directed and not to associate with persons not approved by the probation officer. . Mr R. L. Kerr appeared for Crossley. FINED £3O Russell Graham Barton, aged 18. a workman <Mr R. G. Blunt), was fined £3O and was placed on probation when he appeared for sentence on a charge of unlawfully taking a car valued at £l5O at Dunedin on April 4. Barton was ordered to Itve and work where directed and not to associate with any persons not approved of by the probation officer. ASSAULT A young man, whose name was suppressed, was fined £35 and was placed on probation for 18 months when he appeared for sentence on a charge of assaulting a female on April 12. He was ordered to undergo psychiatric treatment. THREE MONTHS' GAOL Gene Tyrone, aged 67, a retired engineer, was sentenced to three months' Imprisonment on a charge of stealing a motor mower valued at £5. He was appearing for sentence. "You have had a large number of convictions, many of them for offences involving dishonesty," said the Magistrate. FINED £25 Edward Tuma Tokona. aged 29, a factory worker, was fined £25 and was ordered to make restitution of £5 when he appeared for sentence on a charge of stealing four crates of empty soft-drink bottles. "On almost every occasion you have been given three months’ imprisonment.” DROVE UNDER INFLUENCE William Joseph Lamberton, agde 55, a timber worker, was fined £5O, and his driver’s licence was cancelled for three years, on a charge of driving under the influence of drink or drugs in Glandovev road on July 22. He was fined £lO on a charge of using obscene language, and was ordered to pay costs on a charge of having no warrant of fitness. Mr R. F. B. Perry appeared for Lamberton. ! THEFT AS SERVANT A youth, whose name was suppressed, was remanded on bail to August 8 for sentence on a charge of theft as a servant of £1 Ils. He pleaded guilty. Glue), was remanded on bail to August 8 for sentence on a charge of receiving from Kenneth Ruben Brown 320 packets of tobacco and 10,000 cigarettes when he knew they had been dishonestly obtained. SUSPENDED SENTENCE The accused had quite an extensive list of convictions, said Senior-Sergeant Cleary when Clifford Merle Fry, aged 46. unemployed, pleaded guilty to a charge of being idle and disorderly in that he had insufficient lawful means of support on July 26. Fry was convicted and ordered to appear for sentence within six months if called on. DISCHARGED John Charles Toote-lt, aged 18, an apprentice plumber (Mr R. G. Blunt), charged with behaving in a disorderly manner in a public place on June 14, was discharged under section 42 of the Criminal Justice Act. and ordered to pay £7 towards the cost of the prosecution. He pleaded not guilty. Senior-Sergeant Cleary said that Tootell and two friends were walking along Madras street and one of them handed TooteM a knife with a blade that sprang out when a button was pressed. Tootell flicked the knife at another youth and passed it within about a foot of bis face. Mr Blunt said that TooteM acted on impulse and there was nothing sinister about it. TooteM was highly regarded by his employer. DROVE UNDER INFLUENCE A fine of £4O. with cancellation of his driver’s licence for three years, was imposed on Edward George Wood, aged 42, on a charge of driving on Ferry road while under the influence of drink or drugs on June 14. He pleaded guilty. STOLE BICYCLE Dale Preston Bowen, aged 18, a workman, charged with theft of a bicycle worth £25 on May 28, was convicted and fined £2O and ordered to make restitution of £lB. He pleaded guilty. FINED £25 Pleading guilty to unlawfully taking a bicycle worth £23 on June 8, Toby Rutangl Gray, aged 21, a labourer, was convicted and fined £25 and ordered to make restitution of £6. STOLE TYRES James Kalrau Keremeta, aged 26. a soldier, and Henry Vincent Kulti, aged 27. a soldier, were each fined £3O for stealing tyres valued at £9, the property of the Army at Burnham. They pleaded guilty. DAMAGED SHRUBS Pleading guilty by letter to a charge of wilfully damaging three shrubs in the South Paci fie shopping mall. New Brighton. on June 1, Leslie Cecil Reed, aged 18. a factory worker, was fined £lB and ordered to make restitution of £1 10s. INTERFERED WITH CAR Desmond Leon Fitzgerald, aged 36, a workman (Mr J. R. Milligan), was convicted and fined £l5 for unlawfully interfering with .a car on July 4. He pleaded not guilty. STOLE GROCERIES Richard Alexander Brooke and Alexander James Drummond, both students, aged 18. pleaded guilty to stealing groceries worth £2 4s 6d from Self Help. Ltd., 638 Colombo street, yesterday. They were convicted and remanded on bail to August 4 for sentence. REMANDED On a charge of threatening to kill Margaret Van Der Heyde on July 27. G Hattaway) of shooting ducks oi. a fed pond on his property during the open season on May 9 was dismissed Moore pleaded not guilty. The Magistrate said he was not prepared to hold that Moore knew the pond had been fed. STOLE RELISH A housewife whose name was suppressed (Mr G. S. Btockett) was convicted and fined £lO on a charge of theft of a bottle of relish valued at 3s 6d, from Stuart Wilson's stall on the Old Tai Tapu road on June
