Magistrate’s Court Six Month’s Imprisonment For Burglary

Leslie Desmond Johnston, aged 35, a driver, was sentenced to a total of six months’ imprisonment when he appeared in the Magistrate’s Court yesterday before Mr E. A. Lee, S.M., for sentence on two charges of burglary. Johnston was charged that he broke and entered a building at 349 Fairford street on January 31 and again on February 9. He was sentenced to six months’ imprisonment on each charge, the terms to be concurrent. Mr R. J. Allan appeared for Johnston. When Norman Charles Butler, aged 27, a driver (Mr R. S. D. Twyneham) appeared for sentence on a charge of breaking and entering with intent on February 9 premises at 349 Fairford street, the Magistrate said: “I’m prepared to accept that you were led into this offence by Johnston.” Butler was fined £4O, placed on probation for 18 months, and was ordered to take out a prohibition order. The Magistrate said he noted that the offence was Butler’s first since 1961. INCEST "This was a shocking series of offences. It would seem incredible to the ordinary person that a father could stoop so low,” said the Magistrate when he sentenced William Henry Russell, aged 60, retired (Mr J. H. M. Dawson), to f our years’ imprisonment on three charges of incest. The offences took place between May 1, 1962, and July 31, 1962, September 30, 1964, and May 31, 1965, and September 30, 1964, and May 31, 1965. FIVE SENTENCED “This was disgraceful conduct for which the law prescribes a heavy penalty,” said the Magistrate when five youths, whose names were suppressed, appeared before him for sentence, three on charges of having unlawful sexual intercourse with a girt aged 12 years four months, and two for attempting to have unlawful sexual intercourse with the same girl, all on December 28. They were fined £2O each. Making the order for suppression of their names, the Magistrate said that he was doing so only because of their families. Mr G. T. Scott and Mr B. A. Barrer appeared for the youths. The Magistrate said that ■the probation officer’s report in each case was favourable. “There is a good deal more in life than sitting in cars at beaches and going to parties and drinking beer. A girt may be promiscuous, but she is protected by the law,” said the Magistrate. TWO YEARS' DISQUALIFICATION

Leslie James Marsh, aged 20, a workman, who was appearing for sentence on a charge of driving while disqualified in Cathedral square on December 19, was imprisoned for two months and disqualified from driving for a further two years. On a further charge of using a motor vehicle carelessly in Cathedral square on the same date, he was convicted and discharged. The Magistrate noted that Marsh had two previous convictions for driving while disqualified.

TWO CHARGES “This was a pretty stupid business, but I take into account that you’ve spent several days in custody,” said the Magistrate when Richard Henare, aged 24, unemployed, appeared for sentence on charegs of wilfully damaging a door, the property of William Paul Foley, and wilfully damaging three windows, the property of J. L. Gant and Son, both on February 17. He was fined £5 on each charge and was ordered to make restitution of a total of £l4. FINED £lO Gertrude Jean Douglas, aged 59, a widow (Mr G. H. Gould), who pleaded not guilty to a charge of driving at a speed which might have been dangerous in Linwood avenue on November 14, was convicted and fined £lO and her licence was cancelled for 12 months. CHARGE AMENDED Douglas Gordon, aged 19, a storeman, pleaded not guilty to a charge of driving in Lincoln road on November 7 at a speed which might have been dangerous. At the completion of the police evidence and after hearing submissions from Mr D. C. McCaskill, Gordon’s counsel, the Magistrate amended the charge to driving carelessly. Gordon pleaded guilty to that charge, was fined £lO and disqualified from driving for two months from March 10. CHARGES DISMISSED A charge against lan Thomas McDonald, aged 39, a farmer of exceeding 30 miles an hour on Moorhouse avenue on August 25 was dismissed. He pleaded not guilty and was represented by Mr L. G. Holder. A charge against John Cumming McDonald, a manager, of failing to give way to a pedestrian on a crossing in Colombo street on November 22 was dismissed. He pleaded not guilty and was represented by Mr J .F. Burn. (Before Mr H. J. Evans, S.M.) UNLAWFULLY ON SHIP William Stevenson Wylie, aged 38, pleaded guilty to charges of being drunk on the No. 7 wharf at Lyttelton in the early hours of yesterday morning and with being unlawfully on board the motor vessel Limerick. He was convicted and remanded in custody for sentence on Monday on both charges. ASSAULTED WIFE Trevor James Meldrum Humphries, aged 35, a bus driver, who pleaded guilty to a charge of assaulting his wife, Maureen Hannon Humphries at their home on February 28, was convicted and fined £7 10s.
