T.E.A.L. Named In Orchids Claim

BRISBANE, Oct. 12. A nurseryman’s claim for £5235 14s damages against two airline companies over a shipment of orchids from New Zealand was settled on undisclosed terms in the Queensland Supreme Court today. Barry Bernard Cleland, of Burleigh heads, near the Queensland-New South Wales border, claimed the damages from Tasman Empire Airways, Ltd. and the Australian Airlines Commission, trading as T.A.A. Cleland claimed that on April 11, 1960, T.E.A.L. undertook to carry eight cartons of orchid bulbs and house plants from Auckland, for delivery to him at Burleigh Heads, by way of Brisbane. The goods were to be delivered to him by April 15, 1960, but the delivery of the remaining five cartons was delayed until April 20, 1960. Because of this delay the goods in the five cartons were deteriorated and useless for

his purposes and he suffered damages totalling £5235 14s. Both airline companies denied the allegations. They claimed the shipper’s declared value on the face of the air consignment note was £3OOO. When the action was called before Mr Justice Philp today counsel said the matter had been settled.
