Magistrate’s Court Instruction To Traffic Officers On Night Speeding

Christchurch City Council traffic officers had been Instructed to charge with driving at a speed which might have been dangerous anyone caught with the microwave detector exceeding 45 miles an hour after dark. Traffic Officer R. Phillips said when questioned by Mr P. G. S. Penlington in the Magistrate’s Court yesterday. Mr Penlington’s client, Trevor Cyril Watson, a traveller, prosecuted by the City Council’s traffic department, pleaded not guilty to a charge of driving at a speed that might have been dangerous at 11.20 p.m. on June 25. Traffic Officer Phillipa said he checked Watson over twotenths of a mile in Cranford street, and his speed was 49 miles an hour. When stopped, Watson said he did not know he had been going so fast There were no pedestrians and no other traffic, the shops were closed, and the weather was fine, the witness said. Mr K. H. J. Headlfen, S.M., said that although 49 miles an hour might be on the borderline of danger tn a 30-mile-an-hour built-up area, there must be other circumstances to show danger or potential danger. The other circumstances were In Watson's favour. The Magistrate amended the charge to one of exceeding 30 miles an hour. Watson then pleaded guilty, and was fined £6. THEFT OF PETROL The accused syphoned petrol out of trucks parked In a firm’s yard and used It in a rental car, Senior-Sergeant G. M. Cleary said when Raymond Kenneth Ellis Low, aged 19, unemployed, and Michael John Treurn, aged 22, unemployed, pleaded guilty to a joint charge of Mealing 28 gallons of petrol valued at £4 9s lOd between August 28 and August 30. Both were remanded on bail to September 4. INDECENT ASSAULT ALLEGED John Haines, aged 24, a soldier, was remanded to October 1 for psychiatric observation on a charge of indecently assaulting a boy aged 14. DISMISSED A charge of driving at a speed that might have been dangerous, against Donald John Stewart Reid (Mr J. N. Matson), who pleaded not guilty, was dismissed. DISMISSED There was a strong suggestion that there might have been an unexpected movement, said the Magistrate when dismissing a charge against Julian George Shuba, a company representative, of careless driving in Lincoln road on June 12. On March 29 you were warned by Mr E. A. Lee, S.M., that if you appeared before the Court again you would lose your licence. This was a shocking piece of driving, and you acted as a , culpable fool," said the Magistrate when fining Anthony Richard Appleby, an electrical serviceman (Mr C. T. Mahon), £lO on a charge of exceeding 30 miles an hour. Appleby’s licence was cancelled tor four months. Appleby was originallycharged with driving at a speed which might have been dangerous, but the charge was reduced by the Magistrate. Appleby was fined £3 for failing to stop at a compulaory stop sign, and £1 for having no driver’s licence. He pleaded not guilty to the charge of driving at a speed which might have been dangerous, and guilty to the other charges. Evidence was given that about 1.13 a.m. on July 5 a car driven by Appleby was checked at 35 miles an hour in Brougham street and 48 miles an hour In Colombo street. CARELESS DRIVING

Keith Edward Timms, a driver, was fined £7 lot on a charge of careless driving. He pleaded not guilty, and was represented by Mr R. L. Kerr. The charge arose out of an accident between a truck driven by Timms and a truck driven by Robert Edwin Bennett in Rlccarton avenue near the roundabout about 4.13 p.m. on May 22. Bennett gave evidence that he had stopped to put back a bag of cement which was slipping over the edge of the tray.
