MAGISTRATES COURT FOUR “GANGSTERS” SENT TO GAOL

“I am not going to let any elements of this sort of gangsterism get a foothold in Christchurch,” Mr K. H. J. Headifen, S.M., told fourmen who appeared in the Magistrate's Court yesterday for sentence on charges of burglary and car conversion. They were Ronald Anthony Dick, aged 21, Michael Thomas Eunice Hennessey, aged 24, James William Shepherd, aged 23, and Hakaraia Zack Andrews, aged 24, all unemployed. All four had previously pleaded guilty to the charges, which arose from offences committed at Amberley, Kaiapoi and Christchurch. The offences were not only serious, but one involved the abduction of the manager of the Nassella Tussock Board, the Magistrate said. Hennessey and ; Shepherd each appeared on four charges of burglary and two of conversion, and each was sentenced to imprisonment for three years and a half. Dick was sentenced to imprisonment for three years and a quarter on four charges' of burglary and one charge of conversion, and on one charge of burglary and two qf conversion Andrews was sentenced to 15 months’ imprisonment. On a charge of breach of probation Shepherd was convicted and discharged.

Hennessey had one of the worst childhoods that could possibly be imagined, said his counsel (Mr, G. T. Mahon). His complete lack of responsibility probably had its roots in this unfortunate early period. He' realised that he had to bring his present way of life to an abrupt stop. Mr Mahon asked the Magistrate to give some weight to Hennessey’s intentions.

Shepherd’s tragedy was that he was an intelligent person, submitted Mr L. M. O’Reilly. In spite of his poor record ( however, he was not beyond rehabilitation, and on release would do his utmost to keep out of* trouble. In his youth Dick had lacked guidance and a permanent home, said Mr R. F. B. Perry. Though he had appeared before the Court frequently since the age of 13, he should not be regarded as Incurable. Highly intelligent, he would behave more responsibly if given something to do which tested his ability. For Andrews, Mr R. L. Kensaid he was taken to Amberley in a stolen station waggon without being consulted. His part in the offences was minor, except in converting the utility vehicle at Amberley, which, he had done through panic.

“This Court has the duty to see that honest members of the public will be protected from types .such as you,” the Magistrate said to the four men.

He warned them that if they offended again they could be sent to the Supreme Court for sentences of preventive detention. (Before Mr E. A Lee, S.M.) YEAR’S CANCELLATION The defendant drove his car along Bealey -avenue from Manchester street to Barbadoes street at a speed of 55 miles an hour, •Traffic .Sergeant J. McMorran said. It was raining and visibility was only fair. Charged,with driving at a speed that might have been dangerous at - 8.25 p.m. on July 29, Etienne Miles Gray, aged 18, a clerk (Mr M. G. L. Loughnan), pleaded guilty. He was fined £l2 10s, and his licence was cancelled for a Sear. . CARELESS DRIVING Alister Broyme, aged 34, a carpenter, pleaded guilty to a charge of careless use of a vehicle in Ferry road on June 21.. He was convicted and fined £6. Traffic Sergeant McMorran said that Browne was third in a line of cars heading towards Sumner. When the first car stopped, Browne’s car struck the vehicle in front of him, which in.turn struck the leading car.

Browne’s attention was momentarily diverted and he did not have sufficient time to stop, said Mr G. C. P. Beadel. No-one was hurt. Kenneth Neil Balloch, aged 26, a storeman, pleaded guilty to a similar charge. He was convicted and .fined £4. Traffic Sergeant McMorran said that , when Balloch was travelling behind two other cars in Bealey avenue on June 27, he ran into the second car after the leading vehicle stopped to give way to an ambulance. - The two accused took money from an electricity meter in a Dunedin house where they were staying, to pay their fares to the North Island, Senior-Sergeant G. M. Cleary said. To a joint charge of theft of £9 Ils on August 22, Jennifer Kura Te Pou, aged 20, and Mona Sylva, aged 20, both unemployed factory hands, pleaded guilty. They were convicted and remanded in custody to August 31 for sentence.
