MAGISTRATE’S COURT Vian Returned £505 After Stealing It From Employer

A man who took a cash bag containing £505 2s 6d, then returned it because he did not want his fellow workers to be suspected, pleaded guilty to a charge of theft as a servant when he appeared before Mr E. S. J. 'rutchley, S.M, in the Magistrate's Court yesterday. The man, whose name was suppressed, was convicted and remanded on bail to March 20 for sentence.

Detective-Sergeant D. Lee said a cash bag containing the money was left on top oi a cabinet in an office on March 13. The chief clerk was out of the office from 12.30 to 1 p.m., and it was not until 2 p.m. that he noticed the money was missing. Police failed to find the money in spite of interviewing the whole staff. The next day the money was found on the bottom shelf of the strong room. At this stage it was clear a member of the office staff was concerned, but no particular person was suspected. Yesterday the accused approached the manager and admitted the theft, said De-tective-Sergeant Lee. The accused was immediately dismissed, and the police were called. Later in the morning the accused gave himself up to the police at the Central Police Station. The accused said he had taken the bag on impulse, not knowing how much was in it. He could not settle down to work aferwards as he did not want suspicion to fall on his fellow workers. the Magistrate held. ; He dismissed a charge of careless driving against the bus driver, Keith Charteris. The defendant, who was represented by Mr R. E. Wylie, pleaded not guilty. The car’s owner, Maxwell John Fraser, said he had just parked the car when the accident occurred. His car was extensively damaged, and was “written off.” After stopping, the bus driver said it was not his fault as he had had a bout of sneezing and lost control of the bus. Traffic officer K. Stamler said the car was pushed for 34ft partly across a kerb and into a power pole. The defendant, in evidence, said that when he was approaching the parked car he had a sudden burst of violent sneezing. “There was no warning. Suddenly I was blowing my head off.” He tried to swing clear of the car but was too close to avoid hitting it. When he sneezed he must have involuntarily released the tension off the steering wheel and the bus “drifted” into the parked car, the defendant said.

The magistrate said that if the defendant had an involuntary succession of sneezes sufficient to cause momentary loss of control of the bus he could not be convicted unless he knew beforehand of this affliction. The evidence, however, was that the defendant had experienced only three or four light bouts of sneezing in the past, none of them severe, and that he did not know of his affliction until a medical examination after the accident. THEFT ADMITTED Charged with stealing a three-piece silver tea set and tray from the Esplanade Hotel, New Brighton, on January 4, William Benjamin Little, aged 26, a footwear mechanic, was convicted and remanded on bail to March 19 for sentence. Detective-Sergeant D. Lee said the offence was committed before a burglary for which Little was at present on probation. REMANDED

Charged with extortion of £7O at Hanmer Springs on February 21 by a letter threatening to disclose sexual misconduct, James Davies, aged 39, a porter, was remanded on bail to March 19. TRAFFIC CASES

South Brighton

Dance

The captain of the South Brighton Surf Club (Mr G. Silvester) said yesterday that a Magistrate’s Court report in “The Press” yesterday morning about a dance at the South Brighton Community Centre Hall suggested that the dance was held by the club. This was not correct. The dance was run by Surf City which had no connexion with the club.
