MAGISTRATE'S COURT Fined £20 For Careless Driving Causing Death

The driver of the car, William Henry Donald Barnett, aged 42, a schoolteacher (Mr B. McClelland), appeared on a charge of using a motor car carelessly, causing the death of a person. evidence that Sutherland approached the intersection aft a high speed and entered it too fast. The defendant was travelling at a slow speed, changed down, and looked to the right, but did not see Sutherland’s car. The defendant had done all that was required of him, the Magistrate said wlien dismissing a charge against Frederick Allan Skates, aged 26, a costing clerk, of careless driving causing the death of his father, Joseph Skates, aged 65. Skartes pleaded not guilty, and was represented by Mr J. G. Leggait. Sergeant B. D. Read prosecuted. The Charge arose out of a collision between a car driven by the defendant and one driven by David Bruce Sutherland, a clerk, at the corner of Hendersons and Sparks road about 4.20 p.m. on Sunday, June 16. BUGLARY ADMITTED On two charges of burghry and one of false pretences involving a valueless cheque for £l4 12s, Graham Rowlands, aged 23, was remanded in custody to December 16 for sentence. He pleaded guilty. Sergeant Read said that Raymond Eader, of Tennyson street, complained to Ihe police on two occasions that Inis flat had been entered and cheques and a transistor radio, valued at £22, bad been stolen. Rowlands admitted' selling the radio to a dealer for £4. Rowlands bought cigarettes from Raymond Leslie Ward, of 283 Colombo street, with a cheque for £l4 12s. The Cheque was returned marked no account. Rowlands spent the money on rent and incidentals, and on his girlfriend. He came to New Zealand from Australia and had previous convictions, Sergeant Read said. STOLE CAMERA When staying at a flat, Janet May Jordan, aged 25, a machinist, stole a camera valued at £l2, the property of Eugene Baker, a member of the United States Navy, Sergeant Read said. Jordan was remanded on bail to December 20 for sentence. She pleaded guilty. Sergeant Read said that Jordan sold the camera to a dealer for £5 and gave a false name. Mr A. Hearn appeared for the accused.

REMANDED Robert Cooper Neil, aged 18, and George Chambers Brider, aged 19, were remanded in custody to December 18 on a charge of deserting from the ship Halia ait Auckland on December 8. Lawrence . William Robert Norton, aged 57, was remanded on bail to December 20 on a charge of stealing, as a servant, three pairs of beach shorts, valued at £1 18s 9d. the property of Millers, Ltd., on December 10. Sergeant Read said that other charges were pending. Calder Martin Satherly, aged 18; Allan Sydney Simmiss, aged 19, and Gary Harold Anthony Jeffries, aged 18, were remanded in custody to December 20 on a joint charge of converting a car, valued at £650, at Blenheim on ' December 10. Several other charges were pending, and they included burglary in the Blenheim district, said Sergeant Read. FAILED TO CLOSE SHOPS On changes of failing to close their shops when nonexempted goods were exposed for sale, the following were fined:— Robert Brittain, 2 St. Asaph street, £4; Howard Randell Alexander Low, 403 Ilam road, £3; Ronald Richard Pender, 129 Stanmore road, £3; Barrie Winston Robinson, 62 Holmwood road, £3. On a similar charge, George Humphries, 42 Office road, was ordered to pay costs only. Humphries pleaded not guilty, and was represented by Mr P. Mulligan. TAX CHARGES On charges of failing to make returns of income George Rutherford Caithness, a farmer, was fined £4 and Z.. K. Whitford and Company (Kaikoura), Ltd. £3. For failing to deliver a reconciliation statement to the Department of Inland Revenue William Leslie Campbell was fined £4,

A fine of £2O was imposed on Stanley Trevor McLeish, aged 24, a railways workshop employee, when he was convicted of careless driving causing the death of Rupert Fraser Cameron on August 31. McLeish pleaded riot guilty to the charge, which arose from a collision between his car and Cameron, who was on foot, in Bealey avenue at the intersection of Champion street at 7.30 p.m. Mr A. D. Holland represented McLeish, and Detec-tive-Sergeant A. G. I. Rodgers prosecuted. A passing motorist. Ronald Newman Flatt, said he saw McLeish’s car turn right in Bealey avenue at a speed of about 10 miles an hour. He did not see Cameron until he was lit up by the headlights just before the accident. There was no charge of carelessness to be answered )>ecause visibility was poor and the pedestrian had been hard to see, Mr Holland said. The failure of McLeish to see Cameron caused the collision, which in turn caused Cameron's death, the Magistrate said. He agreed that any lack of care was slight, and death was an unfortunate consequence.
