Magistrate’s Court Fined £7 10s For Disorderly Behaviour In Square

The defendant bad walked out into the roadway in Cathedral square without regard to approaching traffic. It was only the skilful action cd a driver which had resulted in the defendant not being run down, and the defendant Shouted abuse at the driver, said Sergeant V. F. Townshend in the Mag.str**e's Court yesterday. Leonard Charles Campbell, aged 21. was fined £7 10s. in default nine days’ itnorisonjnent by Mr E. A. Lee. S.M., on a charge of disorderly behaviour on October 78. Campbell pleaded guilty. He was originally oharged under the name of Teddy Rang: but this was later ascertained to be false.

Sergeant Townshend said the incident occurred at 6.15 pm. Campbell had been drinking but was not drunk. When questioned by a constable he the ooliceman by standing with his hands behind his back and tried to draw attention ito himself. He bad previous convictions and was in Christchurch on holiday from Auckland.

Brian James Bennett, aged 20, was remanded on bail to November 4 on a charge of driving under the influence of drink or drugs in Riselaw street on October 26. DANGEROUS SPEED On a charge of driving at a speed which might have been dangerous on October 4 i Edward Michael Ennis, aged 22, a railway porter, was fined £2O and had his driving licence cancelled for 18 months. He pleaded guilty. Sergeant J. McMorran said Ennis was checked at a speed of 50 miles an hour along a portion of Moorhouse avenue at 11.5 pm. He was also checked at the same speed through the Sydenham shopping area in Colombo j street. SPEED OF 59 M.P.H. Paul Kenneth McGill, a clerk- was fined £l5 and had his driving licence canI celled for one year on a charge of driving at a speed which might have been dangerous in Lyttelton street, Spreydon. on April 9. Tasker, who was represented by Mr L H Moore, was originally charged with driving at a speed which -night have been dangerous. She pleaded not guilty to this charge.

“DIFFICULT POSITION” The bus driver was in a difficult position, said the Magistrate when dismissing a charge against Leslie Gason Smart, a Midiland bus driver, of careless driving on August 9. He pleaded not guilty and was represented by Mr B. J. Drake. Hazel Grace Brown said at 9.50 a.m. she drove north along Colombo street from Cathedral square and stopped on the inside lane at Gloucester street. As she turned left into Gloucester street with the intention of driving west a bus cut in front of her and struck her car. The left wheels of the bus were in the left lane when she drove up. The bus was also making a left turn into Gloucester street. To Mr Drake Brown said it was the bus driver who had telephoned the traffic department. Mr Drake said the bus was following a normal route to the N.A.C. Air Centre. He stopped in a position where he could make a turn without going on to the wrong side of Gloucester street. If he had stopped right against the kerb this could not be done. There were other cars stopped on his right. The bus driver had no reason to believe that any car would drive up in the narrow space between the bus and the footpath. It was impossible for him to see the small car driven by Brown. CHARGE DISMISSED There was some conflict of evidence as to whether the signal was given in sufficient time for the bus to stop, said the Magistrate when dismissing a charge against Eric Lyons, a Christchurch Transport Board bus driver, of failing to stop for a school patrol crossing in Papanui road on July 30 Lyons, who pleaded not guilty, was represented by Mr R. E. Wylie. The crossing involved was at St. Margaret’s College. Evidence was given by witnesses for the defence that the bus could only have stopped by braking violently.
