Magistrate’s Court Destitute Youth Given Suspended Sentence

Barry Haven Molloy, aged 17, a workman, was convicted in the Magistrate's Court yesterday and ordered to come up for sentence within 12 months, if called upon, when he pleaded guilty to a charge of being idle and disorderly in that he had insufficient lawful means of support on February 6. Mr A. P. .Blair, S.M, was on the bench.

Sergeant B. D. Reid said Molloy was found by the police in Cathedral square in an untidy condition. He said he had not eaten since February 3, and had borrowed money to pay the rail fare from Invercargill to Christchurch. He had only 3d in his possession and had been unemployed since before Christmas.

OBSCENE LANGUAGE Pleading guilty to a charge of using obscene language in Colombo street yesterday, Clifford Earl Watson, aged 28, a deer culler, was convicted and fined £lO. REMANDED Kerl Waihope, aged 32. charged with burgling premises at 227 Manchester street on or about February 3. was remanded in custody to February 22. James Gilchrist Watson, aged 39, charged with assaulting bls wife on February 13, was remanded on bail to February 22.

Lewis said he was a mild diabetic and had never been affected by it before. He was under medical care and had never suffered a blackout. He could remember nothing of the accident.

The Magistrate said it could not be held Lewis was in a state of automation as he drove erratically for about one mile and it should have been apparent earlier that something was wrong.

CARELESS DRIVING Even though failure of the defendant’s brakes had been the immediate cause of the accident, the fact that he failed to see the car until he was between 25 and 30 yards away

demonstrated some lack of attention, said the Magistrate convicting Allan Frederick Leyden, a driver (Mr L. H. Moore), for driving without due care and attention on Blenheim road on October 10. Leyden, who pleaded not guilty, was fined £6.

About 5 p.m. on October 10, a truck driven by Leyden struck a car which was stationary in Blenheim road waiting to turn into Hansons lane. His truck glanced from the car into a heavy truck, and the two vehicles, locked together, careered up over a footpath and into a fence.

Leyden said he had just overtaken the other truck, and suddenly saw the car ahead. He tried to apply the brakes, but could not depress the pedal. The linkage, he later found, had become caught up with those of the clutch. He then tried to veer between the two vehicles, but did not have enough room. CHARGE ADJOURNED

Decision on a charge against Nell Roderick Holland, a car dealer (Mr P. M. Joyce), of driving without due care and attention on November 12, was adjourned till today pending the calling of another witness. Holland pleaded not guilty. Holland, while testing a car was involved in a collision with a vehicle driven by Harold Flewellyn, at the intersection □f Durham and Wordsworth streets.

Holland said he saw the other car coming from his right. As the interesection was off-set, and the other vehicle would have had to change direction

to continue through the crossing, he thought it was obliged to give way. When he saw the driver did not intend stopping, he tried to halt, but the brakes failed to hold and a collision occurred. The Magistrate said brake failure would be sufficient excuse for the mishap. The case was adjourned pending the testimony of an officer at the city council's • testing station where the vehicle was checked shortly after the accident.
