Magistrate’s Court Two Men Sent For Trial On Robbery Charge

On a joint charge of robbery on February 25, Wilkie Campbell, aged 38, a workman, and Maurice Ngamanu Riritahi, aged 24, a workman, were committed for trial at the next sitting of the Supreme Court at Chrisf.church by Messrs P. A. Le Brun and F. J. C. Dann, Justices of the Peace, in the Magistrate’s Court yesterday. On a charge of indecently assaulting a male on February 25. Campbell was also committed for trial. Riritahi was allowed bail, and Campbell was remanded in custody. Campbell and Riritahi pleaded not guilty to the charges after depositions were taken. Mr D. J. Hill appeared for Campbell and Mr P. M. Joyce for Riritahi. George Edward Hocking said he and the two accused spent most of the day drinking at a boarding-house at 292 Armagh street. Hocking said he left the room, and when he went back Campbell had opened a bottle of whisky. The witness said he expressed his annoyance, and the two accused threw him on to the bed and held him down. One took £l5 ■in notes out of his bip pocket. Hocking also alleged his . clothing had been disarranged by Campbell and obscene remarks passed, but he said he had not actually been touched.

Hocking said another person then entered the room, and told the accused to give back the money. They gave hack £lO. Detective Emetit Thomas Mitten said that the accused, when interviewed, claimed they had only been having a bit of fun. Campbell said he could have indecently assaulted Hocking.

DISCHARGED Russell Sears, aged 31, a painter, was discharged when he appeared on a charge of killing by aggravated cruelty a fox terrier on December 25. Sears elected trial by jury, and was represented by Mr R. G. Blunt. Wayne Patrick Collins, aged 19, the owner of the dog, said he was woken In the morning by the screams of his young sisters. He looked out, and saw the accused with a raised spade standing over the dog. The witness said he ran out and pushed the accused away, then ran back Inside and got a rifle and shot the dog, which appeared to be in considerable pain. The Justices said they were not satisfied the dog was dead before it was shot, therefore they would dismiss the charge. (Before Mr E. S. J. Crutchley, S.M.) ASSAULT

Kevin John Thomas Patrick Te Au, aged 31, was fined £l5 on a charge of assault. Te Au pleaded guilty. Sergeant V. F. Townshend said that Te Au was asked to leave a city hotel, and he Srotested. When on the street e assaulted Bruce James Ticemartln, kicking him in the groin. Mr M. G. L. Loughnan, who appeared for the accused, said it appeared there had been some provocation for the assault.

The Magistrate ordered Immediate payment of the fine, in default 14 days’ Imprisonment. SMUGGLING Seen coming off the ship. Van Noort, at Lyttelton on the evening of March 12 with a bulge under his coat, Paul Robinson, an engineer on the Hinemoa, was stopped by a customs inspector, and a transistor radiogram was found under his coat. Robinson pleaded guilty to a charge of smuggling and was fined £25.

Ltd.. £5: Keith Frank Turner, £5: Johan Verwelj. £4; George William Wallis, £5. CHARGE DISMISSED A charge of a breach of the Noxious weeds Act at Akaroa against Elsie Lillian Turner was dismissed. A plea of not guilty was entered by the defendant’s husband.

UNREGISTERED DOG Albert Hartshorne was fined £3 for keeping an unregistered dog.
