NAME OF PAINT COMPANY

Injunction Sought At Auckland (New Zealand Press Association) AUCKLAND December 2. An injunction to restrain a newly-established paint manufacturing Company, British Paints (N.Z.), Ltd., from trading under its name is being sought in the Supreme Court at Auckland by British .Imperial Paints, Ltd., a paint company established here in 1932. Mr Justice Shorland is presiding. Mr C. P. Richmond, for the plaintiff, said it was an unfortunate business problem that had arisen between the'/ two companies. Mr L. P. Leary, Q.C., and Mr D. Mprris are appearing for the defendant, which denies the similarity between the names and contends that the wholesale trade will readily distinguish them. It also submits that the public is influenced by the name of the paint rather than its manufacturer. The hearing is expected to last two days.
