A 8739 PUBLIC NOTICES PUBLIC NOTICE is hereby given that the Kowai County Council at a Special Meeting held in the Council Chambers, Balcairn, on Tuesday, 12th August, 1958, at 8.60 p.m., passed the following resolution: “That in pursuance and exercise of the powers- vested in it by the Counties Act, 1956, the Local Authorities Loans Act, 1956, and all other acts it in that behalf enabling the Kowai County Council, and by virtue of the sanction of the Local Authorities Loans Board granted at a meeting of the Board held on August 5, 1958, hereby resolves as follows: (1) That the Kowai County Council proceed to raise a loan of £2OOO to be known as the Amberley Domain Pavilion Loan, 1958, for the purpose of erecting a new pavilion on the Amberley Domain. (2) That the term for which the said loan or any part thereof may be borrowed shall not exceed twenty years. (3) That the rate of interest that may be paid in respect., of the said loan or any part thereof, shall be such as shall not produce to the lender or lenders a rate or rates exceeding 5 per cent, per annum. ' (4) That the Kowai County Council shall, before raising the said loan or any part thereof, make provision for the 1 repayment thereof by establishing a sinking fund and shall make annual payments to such sinking fund at a rate of not less than three pounds, eight shillings and elevenpence per cent, per annum on the amount of the loan for the time being borrowed and not repaid. (5) That the payment of interest and repayment of principal in respect of the said loan shall be made in New Zealand, and no amount payable as either interest or sinking fund in respect of the said loan shall be paid, out of loan money. (6) That the rate payable for brokerage, underwriting, and procuration fees in respect of the raising of the said loan or any part thereof shall not .in the v aggregate exceed one-half per ’ cent, of any amount raised. (7) That no money shall be borrowed under this sanction after the expiration of three years from the date of the said sanction. (8) That the Council doth hereby appropriate and pledge as security for the repayment of the loan and the charges thereon a special rate of 226/10,OOOths of a penny in the pound (£) on the capital rateable value of all rateable property comprised within the boundaries of the North and Amberley Ridings of the County of Kowai. (9) That the form of security for the payment of the principal and interest on the said loan shall be debentures in denominations of £lOO, £5OO and £lOOO with interest coupons attached. (10) That the Chairman and County Clerk of the County of Kowai be empowered to execute under seal the debentures issued in respect of the said loan.” Public Notice is also given that the foregoing resolution will be submitted to the next Ordinary Meeting of the Council to be held in the Council Chambers, Balcairn, on Friday, 12th September, 1958, at 10.00 a.m., for confirmation as a Special Order. Public Notice is further given that a poll of ratepayers is required to be taken if not less than 5 per cent, of the ratepayers in the above defined area so demand, by writing under their hands delivered or sent by post to the undersigned not later than the day before the bate fixed for the confirmation of the resolution hereinbefore mentioned.
