YOUTH’S APPEAL ALLOWED

Gaol Sentence Quashed

An appeal by Lyall Robert Lewis, aged 20, against a sentence of nine months’ imprisonment for theft was allowed by Mr Justice Adams in the Supreme Court yesterday. The sentence was quashed and replaced by a term of two years’ probation on special conditions. Mr J. G. Leggat appeared for Lewis and Mr C. M. Roper acted as Crown Prosecutor.

Lewis had taken part in a rather daring and skilful theft from a car when £lB2 was stolen, said his Honour. He had been sentenced in the Magistrate’s Court on October 7 to nine months’ imprisonment to be followed by one year’s probation, and was ordered to make restitution of £9O 12s. However, it had been believed at that time that the appellant was 23 years of age and it was now known that he was not yet 21 years, his Honour added. Lewis had also spent six weeks in gaol and it was possible to dispense with the prison sentence and grant probation. Lewis was admitted to probation on condition that he make restitution of £9O 12s, that he take out a prohibition order and abstain from intoxicating liquor. Decree Nisi Granted In an undefended petition for divorce on the ground of living apart for more than seven years, Thomas Hornsby (Mr W. F. Tracy) was granted a decree nisi against Muriel Adele Rose Hornsby (Mr H. M. S. Dawson) by Mr Justice Adams in the Supreme Court yesterday.
