Hearing Of Claim Adjourned

Claiming that he had suffered a permanent partial incapacity when he fell while loading empty cartons on to a truck, Hugh Walter Archibald Macfarlane, aged 51 a storeman (Mr B. A. Barrer) applied for compensation from c. K. Perry, trading as Perry’s Shoes, at a sitting of the Coinpensation Court yesterday.

The hearing was adjourned by Judge Dalglish to tomorrow for further medical evidence to be brought. The defendants were represented by Mr A. W. Brown. Macfarlane claimed compensation at the rate of £9 Is a week from November 5, 1956, to December 13, 1956; at £9 9s a week from December 13 to April 1, 1957; at £lO 9s a week from April 1 to the present time, and compensation for permanent loss of earnlnS power. Alternatively he sought adequate compensation for the injury suffered.

In evidence, Macfarlane said that on the day of the accident he had been lifting goods weighing up to lewt 751 b and fell when a gust of wind blew him off the truck as he was climing on to it. He felt something go in the back of his neck. He had not worked since and had suffered severe pains in the back of the neck. His gross wages had been £l2 9s Id. Andrew Malcolm Perry, a son of the defendant, said that Macfarlane had been employed as warehouseman, cleaner, handyman and machine operator and his attendance at work had always been very good indeed. There was no permanent work suitable for Macfarlane at the firm now, although the company would otherwise have been willing to take him on again.
