LEVIN BOROUGH DISPUTE
DECISION RESERVED IN SUPREME COURT (New Zealand Press Association) . WELLINGTON, October 27. Decision was reserved by Mr Justice Cooke m the Supreme Court today on an application by the Mayor of Levin, Horace Edgar Herring, for a series of injunctions and writs of mandamus against members of the Levin Borough Council. Today’s hearing was a resumption of argument begun on August 2 at Feildmg. Herring was represented by Dr. O C Mazengarb. Q.C., with him Mr G. McLeod. Mr I. H. Macarthur’appeared for the nine borough councillors, all defendants in the action. The facts concerned mostly a meeting °f the Levin Borough Council on February 21, 1955. when the councillors carried a, motion terminating the appointment of the Mayor as chairman of its finance and works committees after the Mayor had ruled the motion out of order and had declared the meeting closed. Berring asked the Court to decide whether the council had thereby exceeded its powers.
