CONVICTIONS QUASHED

APPEAL COURT ORDERS ACQUITTAL (New Zealand Press Association) WELLINGTON, July 21. Mr Justice Cooke today delivered the judgment of the Court of Appeal in the appeals of Clifford Fox and Geoffrey William Fisher against their convictions at Christchurch on charges of breaking and entering the countinghouse of the Christchurch city ab 1-' toirs and committing theft therein. Fox and Fisher had previously been convicted on these charges, but the Court of Appeal had directed that those convictions be quashed and that there be a new trial. It was against the verdicts in this second trial that th 3 appeals were lodged. The' Court of Appeal held that the evidence against Fox and Fisher was mainly circumstantial, and could give rise only to suspicion, and that accordingly the verdict was against the weight of evidence. The convictions were quashed, and the Court directed that a verdict of acquittal be entered. The Court consisted of Mr Justice Cooke, Mr Justice Adams, and Mr Justice North. '
