SALE OF WRECK ON REEF

£3285 Claim Against Commonwealth

MELBOURNE, August 28. Two men who bought a tanker which did not exist on a reef which was not there have successfuly claimed £3285 damages from the Commonwealth. The Full Court of the High Court has awarded this sum to Edward and Keith Mcßae, of Melbourne, for a breach of contract. In March, 1947, the Commonwealth Disposals Commission advertised for tenders to huy a' tanker lying on Jourmand Reef, north Samari, near Milne Bay. in New Guinea. The McRaes, trading in partnership, tendered successfully at £285. After an intensive search they found no reef in the locality called Jourmand Reef, but about 11 miles from the spot described by the commission they found a wrecked barge. In March, 1950, Mr Justice Webb awarded the Mcßaes £756 10s damages, but they appealed, claiming that the amount was insufficient.
