DEMOLITION ORDER
SERVICE THIS WEEK PROBABLE LEGAL POSITION BEING INVISTIGATED The order ftf the demolition of the Army hut male into a home on a section with tko other houses at 62 Charles street Mil probably be served this week on he owner, Mr William Brown, by he Christchurch City Council. • The legal pisition if the demolition order is not dieyed has yet to be definitely detemined. The opinion was expressed yeferday by one authority that if the order was flouted, the council could carf out the demolition and recover the Josts or that the owner could be prcfccuted and, if convicted, ; fined, with further penalties being fixed for a dntinuing offence. Authority JM* a demolition order is contained inflClause 26 of the Christ- , church By-ww No. 15, 1930, which gives building requirements. The clause yads:— “No persdt shall erect any building oj put ip any structure or do any work whichas to design, materials or L workmanshs, is contrary to the provisions of ths by-law, and if any building is erectri or any structure is put up or any Rrork is done contrary to any such jipvision, the council may give the pfson in possession of the premises nlice to pull down and remove such wilding, structure, or work, as the casemay be, and upon his fail-* > ing to comjly with such notice within.
