MAGISTRATE’S COURT

TUESDAY (Before Mr H. P. Lawry, S.M.) REMANDED Leo John Martin, a watersider, aged 26, was remanded to appear on October 6 on a charge of being found without lawful excuse on enclosed premises at Rolleston House on September 29. Harold Hamilton, a gardener, aged 41, was remanded to appear on October 6 on a charge of breaking and entering by day the dwelling-house of William McQueen at Lake Lyndon on September 28, and committing theft. Leslie Robert Thompson, an airman, aged 21, who was charged with the theft at Weedons on April 1 of two navigators’ wrist watches valued at £24, the property of the Royal New Zealand Air Force, was remanded to appear on October 6. On a charge of receiving one wristlet watch valued at £l2 from Thompson, knowing it to have been dishonestly obtained, William George Lapham, an airman, aged 23, was also remanded to appear on October 6.

Both accused are to be kept in the custody of the Royal New Zealand Air Force until that date.

Frederick Ronald Beale (Mr J. K. Moloney), described as a dealer, aged 54, was charged with being a rogue and a vagabond, in that, being a suspected person, he frequented St. Andrew’s Hill road with felonious intent on September 27. He pleaded guilty. Detective-Sergeant A. A. Herron said that accused was found loitering on St. Andrew’s Hill road by the police shortly after the owners of a house had found him on their premises and chased him away. When interviewed, accused said he had not entered the house.

Accused was not a rogue and a vagabond, as he had an occupation. He was a dealer, said Mr Moloney. On the night of September 27 accused had set out to go to a party, and he had a lot of liquor. He did not recollect breaking into or entering any house. He came from a respectable family, and had only been in trouble once before, for stealing a shirt when he was very young. The accused was remanded to appear on October 6. in order that a report could be made by the probation officer (Mr W. H. Darby). Bail was allowed in accused’s own recognisance of £lOO, and one surety of £5O.
